Stokes v Melbourne CC [2009] VCAT 364
The Responsible Authority may extend the periods referred to if a request is made in writing before the permit expires, or within three months afterwards.
Ms Sarah Porritt, barrister, appeared on the instructions of H Hayes, corporate solicitor to the City of Melbourne, for the responsible authority. She presented written and oral submissions.
Ms Tania Cincotta, solicitor of the firm Best Hooper, solicitors, appeared for the applicant. She presented written and oral submissions.
Various plans, photographs and other documents were tendered in evidence. The evidence and submissions in documentary form have been retained on the file of the Tribunal.
Application under Section 79 of the Planning and Environment Act 1987 for review of the failure of the Responsible Authority to grant a permit within the prescribed time.
Extensions to living room and bedroom of units 702 and 703 on Level 7 of an eight level building.
Business 2 Zone and subject to a Heritage Overlay (Schedule 2) and a Design and Development Overlay (Schedule 20) under the Melbourne Planning Scheme.
A permit may be granted to construct a building or construct or carry out works which are not in accordance with any requirement in a schedule to this overlay unless the schedule specifies otherwise.
Buildings or works should not exceed the maximum building height...specified in the table to this schedule.
An application to exceed the maximum building height...must be accompanied by a site analysis plan and a written urban context report documenting how the development will achieve the specific design objectives and outcomes of this schedule.[3]
The height of a building or works is the height of its highest point above the permanent footpath at the centre of the site frontage. If there is no footpath, the natural surface level at the centre of the site frontage is the base level.
New buildings or works do not impact upon the visual attractiveness of Fitzroy Gardens or create additional overshadowing on the gardens between 11.00 am and 2.00 pm on 22 March or 22 September.
No buildings may be constructed that protrude above a plane inclined at an angle of 22 degrees from a point that is:
In Area 43, before deciding on an application, the responsible authority must be satisfied that the building or works would no protrude above a plane elevated from the same point to the highest southern parapet of a building fronting Victoria Parade to the north of the site.
A permit cannot be granted to vary the Maximum Building Height specified in Table 1 to this schedule.
Buildings or works should not exceed the Maximum Building Height specified in the Table to this schedule.
That clause goes on in somewhat similar terms to schedule 20 to talk about an application to exceed the Maximum Building Height that must demonstrate how the development will continue to achieve the design objectives and built form outcomes of the schedule and any local planning policy requirements.
[3] I have already quoted the design objectives. The table to the schedule mentioned in the first paragraph of this quotation does specify some outcomes.
