LANDLORD AND TENANT - Interlocutory injunction - whether there is a serious question to be tried as to whether rent and outgoings are in arrears - whether the tenant is entitled to an equitable set-off - whether a "no deductions" clause in the lease impeaches the tenant's rights arising under s 52 of the Retail Leases Act 2003 (Vic) ('the RLA') and is contrary to s 94 of the RLA - C & A Delaveris Pty Ltd v Bretair Pty Ltd [2009] VCAT 1663 considered - whether an equitable set-off prevents an order for possession in circumstances where the lease has already been lawfully terminated - Qian Long Zan Pty Ltd v Ka Yan Butt No 2 (Building and Property) [2025] VCAT 546 considered - whether the balance of convenience favours a granting of an interlocutory injunction.
STG Dental Pty Ltd v Mannerside Holdings Pty Ltd (Building and Property) [2025] VCAT 842
It is common ground that on an application for an interlocutory injunction, the Court will need to determine whether there is a serious question to be tried as to the plaintiff's entitlement to relief; whether the balance of convenience favours the granting of an injunction, including whether the plaintiffs are likely to suffer an injury for which damages will not be an adequate remedy; and whether there are any discretionary considerations which weigh for, or against, the grant of relief. These questions must be examined together.[3]
