1. An amended site plan to show the provision of three (3) car parking spaces within the road reserve of Macs Street, in accordance with the submitted engineering plans by Woodhouse Graesser Johnston (Project no. 12.290); 2. A landscape plan to show a planting schedule of all proposed trees, shrubs and ground covers, including botanical names, common names, pot sizes, sizes at maturity, and quantities of each plant. Selected species must be native and indigenous to the Peterborough Area (please see note 1). The plan must not include the use of any environmental or declared noxious weeds, and must show the provision of satisfactory landscaping within the western extent of the site, in order to act as a buffer to soften the visual impact of the development; and

1. Details of surface finishes of pathways and driveways on a landscape plan. In this regard, the crossover and driveway to the garage must be of crushed rock topped with a screenings mix or similar surface, while the driveway for deliveries and staff car parking can be either of crushed rock topped with a screenings mix or similar surface or of a more durable surface.
2. The development as shown on the endorsed plans must not be altered without the written consent of the responsible authority.
3. Within six (6) months of the completion of the development or within the next applicable planting season, whichever is the earlier, the landscaping works shown on the endorsed plans must be carried out and completed to the satisfaction of the responsible authority.
4. The landscaping must be provided with an adequate water supply and mulching to ensure the health and continued growth of the vegetation to the satisfaction of the responsible authority. The landscaping shown on the endorsed plans must be maintained to the satisfaction of the responsible authority and if any plants die, become diseased or damaged they are to be replaced with a similar species to the satisfaction of the responsible authority.
5. Before the development starts, a schedule of the external finishes of the development (including walls and roof materials) must be submitted for approval to the satisfaction of the responsible authority. The external finishes must be constructed in muted, non-reflective materials and tones which blend in with the landscape of the area to the satisfaction of the responsible authority.
6. No plant, equipment, services or architectural features other than those shown on the endorsed plans are permitted above the roof level of the buildings without the written consent of the responsible authority.
7. Unless no permit is required under the Planning Scheme, signs must not be constructed or displayed without a further permit.
8. Care must be taken to ensure that the construction of the development and any ancillary works does not cause erosion or degradation of the subject or surrounding land to the satisfaction of the responsible authority.
9. The permit holder must use appropriate site management practices to prevent the transfer of mud, dust, sand or slurry from the site into drains or onto nearby roads and properties. In the event that any road, drain or adjoining property is affected, the owner must upon direction of the responsible authority take the necessary steps to clean the affected portion of road or drain to the satisfaction of the responsible authority.
10. External waste storage areas shall be restricted to the storage bin area adjacent to the stairs of the 'shop' shown on the endorsed plan or to properly surfaced and drained areas (for pressed or baled materials only). Storage bins shall be screened from view of the street and adequately covered to the satisfaction of the responsible authority to minimise dispersal of material by wind or water and vermin and pest insect access. Appropriate controls shall be implemented to restrict the movement of windblown litter and prevent the site appearing unsightly.
11. No litter shall be discharged beyond the boundaries of the site to the satisfaction of the responsible authority.
12. All storage areas shall be surfaced and capable of being washed down with waste water being directed to sewer via an appropriate litter trap to the satisfaction of the responsible authority.
13. No odour shall be emitted from any waste storage areas so as to cause offence to adjoining property owners to the satisfaction of the responsible authority.
14. Deliveries to and from the site (including waste collection) must only take place between 7am and 5pm Monday to Friday and 7am to 1pm Saturday to the satisfaction of the responsible authority.
15. External lighting must be designed, baffled and located so as to prevent any adverse affect on adjoining land to the satisfaction of the responsible authority.
16. All stormwater is to be disposed of in accordance with the endorsed plans Stormwater Drainage Design Plans, as prepared by Woodhouse Graesser Johnston (Project no. 12.290) to the satisfaction of the responsible authority.
17. All necessary works for the construction of three (3) car parking spaces within the road reserve of Macs Street, including any other works that are considered necessary by the responsible authority shall be constructed in accordance with plans, computations and specifications as prepared by Woodhouse, Graesser Johnston (project no. 12.290) submitted to and approved by the responsible authority before the development starts. Such works shall be designed and installed to transport stormwater run-off from the subject land and surrounding land or adjoining roads to an approved point of discharge.
18. All engineering works shall be completed to the satisfaction of the responsible authority before the occupation of the development.
19. Before the commencement of filling in any particular area of the site, topsoil shall be stripped and stockpiled on the site to the satisfaction of the responsible authority. Topsoil is not to be removed from the site but stored to be used and spread over the site on completion of the filling operation, with additional soil of needed, to a depth of 100 millimetres.
20. Only clean inert filling shall be deposited on the site to the satisfaction of the responsible authority.
21. All retaining walls constructed within the site shall be constructed to incorporate an impervious barrier to the satisfaction of the responsible authority.
22. The crossover for the dwelling must be constructed of crushed rock topped with a screenings mix or similar surface in accordance with the permit to the standards and satisfaction of the responsible authority while the crossover to the deliveries and staff parking area must be constructed to the standards of the responsible authority and to the satisfaction of the responsible authority.
23. Car spaces, access lanes must be maintained and kept available for these purposes at all times to the satisfaction of the responsible authority.
24. This Permit will expire if:
    • The development does not start within two years from the date of this Permit; or
    • The development is not completed and the use not started within four years of the date of this Permit.

In accordance with Section 69 of the Planning and Environment Act 1987, an application may be submitted to the responsible authority for an extension of the periods referred to in this condition.

[1] I have considered all submissions presented by the parties although I do not recite all of the contents in these reasons.

[2] I provide this site coverage analysis to assist in describing that the Schedule envisages in terms the parties would recognise. I acknowledge the combined site coverage of buildings on the review site is 54.7% and acknowledge the Blair Street frontage of the dwelling is less than 10 metres. I will address these matters separately. Here I am only suggesting that dwellings and garages comparable to those in this proposal would comply with the height and site coverage guidance for the Neighbourhood Character Zone in 'Old Peterborough'
