(1) By consent, the Commission should rescind the Security Industry (State) Award.
(2) The Commission should rescind the Miscellaneous Workers - Kindergartens and Child Care Centres, &c. (8) That no change is required to the Local Government, Aged, Disability and Home Care (State) Award. It is not an obsolete Award, although it only covers a relatively small number of workers. (9) That no change is required to the Nurses' (Local Government) Residential Aged Care Consolidated (State) Award 2021, for essentially the same reasons for the absence of any need to change the Aged, Disability and Home Care (State) Award. ANNEXURE A - REPORT OF COMMISSIONER MCDONALD TO THE FULL BENCH (24 JULY 2025)
(1) By consent, the Commission should rescind the Security Industry (State) Award.
(2) The Commission should rescind the Miscellaneous Workers - Kindergartens and Child Care Centres, &c. (State) and replace it with a new award to be called the Kindergartens and Child Care Centres (State) Award which, inter alia, provides for rates of pay in line with the Children's Services Award 2010 (Cth).
(3) The Commission should rescind the Health, Fitness and Indoor Sports Centres (State) Award and replace it with a new award of the same name to provide for, inter alia, rates of pay in line with the Fitness Industry Award 2020 (Cth), adjusted to maintain relativities.
(4) By consent, the Commission should vary the Transport Industry (State) Award to provide for rates of pay in line with the Road Transport and Distribution Award 2020 (Cth) and to make various other amendments as agreed by the parties.
(5) By consent, the Commission should rescind the Clerical and Administrative Employees (State) Award.
(6) The Commission should vary the Local Government (Electricians) State Award to uplift some apprentice rates, in line with the comparable federal award and to update and improve some references used in the Award (as explained below).
(7) The Commission should vary the Entertainment and Broadcasting Industry - Live Theatre and Concert (State) Award to increase the rate of pay for "Theatrical employee- level 3" and the transmission and recording allowance, in line with the Live Performance Award 2020 (Cth) and to make various other amendments to the award, as agreed by the parties.
(8) That no change is required to the Local Government, Aged, Disability and Home Care (State) Award. It is not an obsolete Award, although it only covers a relatively small number of workers. A variation to this Award to pass on increases to rates of pay awarded by the Fair Work Commission (FWC) to aged care workers as part of its Aged Care Work Value Case and to partially resolve related dispute proceeding no. 2024/483819, was made by me on 13 and 25 June 2025, pursuant to a consent application made by the Health Services Union: Local Government, Aged, Disability and Home Care (State) Award [2025] NSWIRComm 1034.
(9) That no change is required to the Nurses' (Local Government) Residential Aged Care Consolidated (State) Award 2021, for essentially the same reasons. A variation to this Award to pass on increases to rates of pay awarded by the Fair Work Commission (FWC) to aged care workers as part of its Aged Care Work Value Case and to wholly resolve related dispute proceeding no. 2024/483819, was made by me on 21 July 2025, pursuant to a consent application made by New South Wales Nurses and Midwives' Association: Nurses' (Local Government) Residential Aged Care Consolidated (State) Award 2021 - Award Variation; Unions NSW v Local Government NSW [2025] NSWIRComm 1051.
"12. The Commission will take account of those matters [set out in s 19(3) and (f) of the IR Act] in the context of the objects of the 1996 Act, which are specified in s 3 and the matters set out in s10, which provide that awards be made to set fair and reasonable conditions of employment for employees. The Commission will have regard also to the public interest, will seek to balance the interests of employers and employees and will do so in the context of the operation of the award(s) under review.
13. A 'test case' decision referred to in s19(3)(a) means a decision made under Part 3 - National and State decisions of Chapter 2 of the 1996 Act or any other decision which the Commission determines to be a test case having general application to awards in the State.
...
Obsolete awards
22. For the purpose of the award review process 'obsolete award' means:
(a) there are no employees or employers under that award;
(b) the award is not a counterpart of a federal award; and
(c) there is no enterprise agreement approved under Part 2 of Chapter 2 of the 1996 Act in force fixing rates of remuneration and/or other conditions of employment in the industry or occupations covered by the award.
23. Where no application to vary an award has been made for 5 years or more, it indicates that the award may be obsolete and requires rescission.
24. An award which covers only a small number of employees is not, by that fact alone, obsolete.
25. The rescission of obsolete awards may be dealt with by the parties, independent of the review process, in accordance with s 20 of the Act.
Changes to the award
26. In accordance with s19(6), after hearing the parties the Commission may make such changes to the award as it considers necessary as a result of the review. Such changes include modifying or removing provisions of the award, consolidating a number of awards or rescinding obsolete awards."
5. Principles 4.1 and 4.2 of the Wage Fixing Principles made in State Wage Case 2022 provided:
"4.1. Following the completion of an Annual Wage Review by the Fair Work Commission, the Commission will issue a notice to show cause why that decision should not be flowed on to relevant New South Wales awards (as per 4.2 of this Principle) in the New South Wales industrial jurisdiction.
4.2. Unless the Commission determines otherwise, the following New South Wales awards:
(1) Security Industry (State) Award ("Security Industry Award");
(2) Miscellaneous Workers - Kindergartens and Child Care Centres, &c. (State) Award;
(3) Health, Fitness and Indoor Sports Centres (State) Award;
(4) Transport Industry (State) Award;
(5) Clerical and Administrative Employees (State) Award;
(6) Local Government (Electricians) (State) Award;
(7) Entertainment and Broadcasting Industry - Live Theatre and Concert (State) Award;
(8) Local Government Aged Disability and Home Care (State) Award; and
(9) Nurses' (Local Government) Residential Aged Care Consolidated (State) Award 2021
(collectively "Relevant Awards") will be varied to include a State Wage Case adjustment by the making of one or more orders of the Commission pursuant to s 52, and where relevant, s 146C of the Act, subject to the following:
...."
6. The "Relevant Awards" are what are referred to as 'minimum rates' awards, that is, they prescribe a floor, but not a ceiling, for remuneration to be paid to employees covered by such awards. Such awards are in contradistinction to 'paid rates' awards, which represent the majority of awards made by the Commission, and which prescribe rates an employer is obliged to pay to employees and which in practice will be the actual remuneration received by the employee.
7. State Wage Case 2024 (No 2) was the Commission's determination referred to in sub-principle 4.2 arising from the FWC's 2024 Annual Wage Review.
8. The Full Bench in State Wage Case 2024 (No 2) at [3], categorised the Relevant Awards into three groups as follows:
Category 1
1. Security Industry (State) Award;
2. Miscellaneous Workers - Kindergartens and Child Care Centres, &c. (State) Award;
3. Health, Fitness and Indoor Sports Centres (State) Award;
4. Transport Industry (State) Award;
5. Clerical and Administrative Employees (State) Award;
Category 2
1. Local Government (Electricians) (State) Award;
2. Entertainment and Broadcasting Industry - Live Theatre and Concert (State) Award;
Category 3
1. Local Government Aged Disability and Home Care (State) Award; and
2. Nurses' (Local Government) Residential Aged Care Consolidated (State) Award 2021
9. Category 1 are awards covering employees in service of the Crown, where the Industrial Relations Secretary is the statutory employer and where such employees were previously subject to the Industrial Relations (Public Sector Conditions of Employment) Regulation 2014 (Regulation) (and its 2011 predecessor) and the now superseded Public Sector Wages Policy, which together imposed what was commonly referred to as the "wages cap". As has been well published (sic) [publicised] , the "wages cap' was abolished on 1 September 2023 when the Regulation was repealed.
...
15. Despite being given the opportunity to do so, no party filed any evidence in respect of the first stage of the State Wage Case 2024. Only Unions NSW, Local Government NSW and the Industrial Relations Secretary filed submissions_._ Those submissions gave rise to two concerns: first, that some of the Relevant Awards may be obsolete, as there may be no current employees covered by one or more of the awards and no current intention by the relevant employer to employ persons in positions covered by such awards; and second, that the rates prescribed in the Relevant Awards, even after the uplift awarded in State Wage Case 2024 (No 2), may not represent fair and reasonable wages in conformity with the Commission's obligation, pursuant to s 10 of the IR Act, to make awards setting fair and reasonable conditions of employment for employees. The Full Bench found, at [25], that at least over the last five years, the increases awarded to the minimum rates in the Category 1 Awards have been insufficient to keep pace with inflation, such that they have decreased in real terms, and to a degree greater than the reduction in the real value of rates under federal modern awards. The Full Bench expressed a concern that the wages for Category 1 awards may have fallen behind federal modern award minimum rates in real terms, including most concerningly, the National Minimum Wage Order as determined by the FWC, possibly due to the wages cap.
16. In the circumstances, the Full Bench considered that a comprehensive review of the rates in the Relevant Awards is warranted, explaining, at [31] - [32]:
[31] ... Such a review should be directed to ensuring that these rates represent fair and reasonable wages in conformity with the Commission's statutory mandate. After their decline in real value during the last five years, due in large part to the operation of the former wages cap, the Commission can have no confidence that its statutory mandate is fulfilled simply by applying the AWR 2024 increases to the Category 1 awards from 1 July 2024.
[32] In addition, we are concerned that the absence of any evidence of the impact of increasing wage rates may reflect the limited application of the Category 1 awards, or even the potential obsolescence of one or more of those awards (including potentially awards in Categories 2 and 3). This concern is reinforced by the question raised [by LGNSW] over the Entertainment and Broadcasting Industry - Live Theatre and Concert (State) Award referred to in [10] above and the absence of any employees currently engaged in the classifications [in the Category 1 awards] referred to in [27] above. The review should also ascertain the extent to which these awards have practical application, and to deal with them appropriately, whether by rescission of one or more awards or by further adjustments to the wage rates contained in them."

1. Pursuant to ss 11(1)(a),15(3) and 17 of the Industrial Relations Act 1996 the Transport Industry (State) Award, made on 9 October 2024 and published on 23 May 2025 (397 IG 2129) is varied as shown in the marked up version of the Award filed by the Industrial Relations Secretary on 18 June 2025, but with the following change:

Clerical and Administrative Employees (State) Award
"... is the comparable federal modern award for 7 of 11 classifications in the award as follows:
a. The four classifications of apprentice from 1st year to 4th year.
b. The three classifications of Technical/Trades from Level 1 to Level 3.
6. However, the federal Professional Employees Award 2020, and not the federal [Modern Electrical] Award, is the relevant comparator federal modern award for the remaining four classifications of "Professional" from Levels 1 to 4. The reasons are:
a. The coverage clause (cl 4.1(a)) in the Professional Employees Award 2020 is both an "industry and occupational award" and covers "Employers throughout Australia with respect to their employees performing professional engineering and professional scientific duties who are covered by the classifications in Schedule A - Classification Structure and Definitions of the award and those employees."
b. The "Professional" classifications in the LG Electricians Award cover degree qualified professional engineering or specialist roles and are appropriately matched with classifications in Schedule A of the federal Professional Employees Award 2020. By contrast, the EECC Award covers technical and trades classifications that are based on trade-level qualifications (e.g. Certificate III, Certificate IV, Diploma)."
"Clause 4.3 of the Professional Employees Award 2020 provides that the award does not cover employees of a local government covered by another award. As such, LGNSW believes that the appropriate comparator modern award is the Local Government Industry Award 2020. This view is fortified by a comparison of the skill descriptors contained in both awards."
Electrical, Electronic and Communications Contracting Award 2020
(1) an electrician's licence allowance of $37.16 per week for holding and maintaining an unrestricted licence to carry out regulated electrical work (clause 18.3(b) Modern Electrical Award);
(2) electrical distribution line maintenance and tree clearing allowance of $79.49 per week to compensate for performing high-risk and physically demanding work in vegetation clearing and overhead line environments (cl 18.3(e) Modern Electrical Award)); and
(3) leading hand allowance for supervising and taking responsibility for a team of employees (cl18.3(c) Modern Electrical Award) - $44.39 per week for 3 -10 employees; $61.94 per week for 11 -20 employees; and $83.62 per week for more than 20 employees.
"...it is not sufficient to justify the exclusion of these specific federal pay-related allowances for the following reasons:
a. The industry allowance is in both awards, but the federal award still provides for the additional specific allowances listed above. This indicates that the federal system treats these matters as warranting discrete compensation.
b. The combined value of the federal allowances exceeds the value of the LG Electricians Award general industry allowance. For instance, if an employee is eligible for the industry allowance and all three pay-related allowances that do not exist in the state award, they would receive $238.47 in total allowance compared to just $71.34 which equates to a difference of $167.13.
c. Even accounting for the generally higher rates of pay in the state LG Electricians Award, in some instances, employees who would be entitled to those extra allowances in the federal award would be worse off in total remuneration."
"1. The LG Electricians State Award already includes industry-specific allowances that are varied each year (by consent) in line with any State Wage Case increases, and provide generous rates of pay well in excess of the federal comparator awards as already established in the email of yesterday and in the affidavit of Mr Nassif of 6 March 2025;
2. More specifically, the Leading Hands Allowance (which Mr Aghazarian has recommended for inclusion) is already contemplated by and accounted for in the LG Electricians State Award through the Skill Descriptors at Clause 4, as it is a skills-based allowance. This is further reflected in each Council's salary system rates of pay. Indeed, Clause 25 of the Award acknowledges that employees may be required to supervise or oversee "3 to 10 employees," "11 to 20 employees," or "more than 20 employees", with higher rates of pay applying in accordance with the skills and knowledge exercised in their roles;
3. Again, more specifically, the Electrician's Licence Allowance (which Mr Aghazarian has also recommended for inclusion) is paid to electrical workers who hold and may be required to use an unrestricted electrical licence, which in LGNSW's view is akin to a qualification. If such a qualification is required in a particular role, LGNSW again contends that it is already accounted for by the Skill Descriptors at Clause 4, and subsequently reflected in each Council's salary system rate of pay;
4. Furthermore, the Electrical distribution line maintenance and tree clearing allowance (which Mr Aghazarian has also recommended for inclusion) is paid to employees engaged in clearing trees associated with undertaking maintenance work on electrical distribution lines. LGNSW submits that this is an obsolete allowance as councils in NSW do not perform nor undertake such work in their respective local government areas, hence, there would be no need to include this allowance in the LG Electricians State Award;
5. Mr Aghazarian has recommended the inclusion of the above allowances from the Federal Electrical, Electronic, and Communications Contracting Award 2020 ("EECC Award"). However, this award was selected purely for comparative purposes and does not have any industrial applicability or coverage within the NSW local government sector;
6. As a corollary to point [5], consenting to the inclusion of these allowances could set a precedent that risks "leapfrogging" - opening the door to further claims for allowances from other comparator awards, which would be of significant concern to our members;
7. The inclusion of these allowances would also represent a major departure from established practice in our sector. Historically, changes to awards or variations have only occurred by consent following consultation with our members. In this instance, our members have not been consulted, and it would be highly inappropriate for LGNSW to agree to such inclusions without their input or approval in the first instance;
8. Finally, the scope or ambit of this review, as outlined in paragraph 3(c)(iii) of the Notice of Orders Made on 10 February 2025, was confined to comparing the rates of pay in the relevant award with those in a comparable federal modern award or awards, with a brief rationale for the choice of comparator. The review was limited to rates of pay, not pay-related allowances, and this comparison has already been addressed in detail by the parties."
1. Pursuant to ss 11(1)(a),15(3) and 17 of the Industrial Relations Act 1996 the Local Government (Electricians) (State) Award, made on 8 February 2022 and published on 27 July 2022 (392 IG 292), as varied and most recently published on 23 May 2025 (397 IG 1973), is varied as follows:
a. insert a clause providing for paid family and domestic violence leave in the same terms as that set out in Part M of cl 23 of the Local Government (State) Award;
b. the rate of pay of second and third years apprentices is to be $915.90 per week;
c. in subclause 33(ii), delete the words "Enterprise Agreement Principle" and insert in lieu the words "Review of the Principles for Approval of Enterprise Agreements 2021/2022 (2022] NSWIRComm 1005";
d. in subclause 16(i), insert the words "Easter Sunday" after "Easter Saturday" and delete the word "Queens" and insert in lieu the word "King's";
e. in subclause 30(xi), delete the word "Security" after the word "Social" and insert in lieu the word "Services";
f. in subclause 33(iii)(d), delete the words "the LGSA" and insert in lieu the words 'Local Government NSW";
g. in clause 38, delete the words "the Local Government Superannuation Scheme" and insert in lieu the words "Vision Super"; and
h. in clause 39, delete the words "until varied" in the fourth paragraph and insert immediately before that paragraph the following paragraph:
"This award was reviewed as part of the State Wage Case 2024 and all variations made pursuant to that review take effect from 1 September 2024."
2. The variation is to have effect on and from 1 September 2024.
3. LGNSW is to file by not later than [TBA]:
a. a variation schedule; and
b. a clean copy of the Local Government (Electricians) (State) Award as varied.
Entertainment and Broadcasting Industry - Live Theatre and Concert (State) Award
"22. Subclause 47(i) of the Local Government (State) Award 2023 (the Award) provides that the Award applies to all employees and employers in local government in NSW. However, subclause 47(iii)(i), specifically states that the coverage of the Award does not extend to the employees of Newcastle City Council who are covered by the Entertainment and Broadcasting Industry - Live Theatre and Concert (State) Award.
23. As such, the City of Newcastle is the only council in NSW that could possibly apply the provisions of the Entertainment and Broadcasting Award to employees engaged in Entertainment, Events, Theatres, and Hospitality.
24. On 12 August 2024, the Industrial Relations Lead at the City of Newcastle emailed LGNSW industrial officers about the continued application of the Entertainment and Broadcasting Award. A copy of the email of 12 August 2024 is attached and marked as Annexure MN-2.
25. It is evident from Annexure MN-2 that prior to January 2023 the Entertainment and Broadcasting Award applied to 127 employees of the City of Newcastle. In the period between the first pay period on or after 1 January 2023 and mid-December 2024, City of Newcastle employees engaged in Entertainment, Events, Theatres and Hospitality venues operated by the Council were covered by the terms and conditions of employment outlined in Schedule 6 of the City of Newcastle Enterprise Agreement 2023 (393 IG 1022). A copy of Schedule 6 of the City of Newcastle Enterprise Agreement 2023 is annexed and marked as Annexure MN-3.
26. In December 2024, pursuant to clause 46 of the City of Newcastle Enterprise Agreement 2023 the Council along with the Local Government, Clerical, Administrative, Energy, Airlines & Utilities Union (the Union), entered into a Council Agreement that applies to Entertainment, Events, Theatres and Hospitality employees previously covered by Schedule 6 of the City of Newcastle Enterprise Agreement 2023. Annexed and marked as Annexure MN-4 is a copy of the City of Newcastle Enterprise Agreement 2023 & Schedule 6 Amendments Agreement 2024.
27. I am of the view that the provisions of the Entertainment and Broadcasting Award do not currently apply to City of Newcastle employees engaged at Entertainment, Events, Theatres and Hospitality venues operated by the Council. That is not to say that the City of Newcastle employees are not covered by the Entertainment and Broadcasting Award.
28. If the Commission were to rescind the Entertainment and Broadcasting Industry - Live Theatre and Concert (State) Award because it does not have application to any employees in local government, then I am of the view that at the same time an amendment would need to be made to remove subclause 47(iii)(i) of the Local Government (State) Award 2023."
"23. The CNEA is clearly an enterprise agreement of the type referred to in Limb 3. The replacement CNEA defines its coverage of employees (among other areas of coverage) solely by reference to the Entertainment Award, "The Agreement covers and applies to employees who... transitioned from the Entertainment end Broadcasting Industry - Live Theatre and Concert (State) Award coverage to CN's EA 2023 coverage as from FFPP 1 January 2023."
"22. The Entertainment Award covers the "live theatre and concert industry" (cl 5.1 and 3.18). Clause 3.8 broad classification descriptors for the various venue support and technical crew covered by the award. For example:
(a) Stage door duties (cl 3.10.3(j)) are duties for occupations such as Front of House Theatre Managers and Front of House Attendants.
(b) Lifting and scene/props handling (cl 3.10.3(l)) and scenery, building and prop construction (cl 3.10.3(m)) are duties for occupations such as Staging Technician and Production Support.
(a) The SOHEA fixes rates of remuneration and other conditions of employment in the industry covered by the Entertainment Award. The SOHEA covers as being the "performing arts industry", which is analogous to the coverage of the Entertainment Award in the "live theatre and concert industry".
(b) The SOHEA fixes rates of remuneration and other conditions of employment for occupations covered by the Entertainment Award, being theatre and venue support and technical crew. These occupations correspond to those described in cl 3.8 of the Entertainment Award classification descriptors, which also cover theatre and venue support and technical crew.
25. The Entertainment Award is not an obsolete award given that it does not satisfy Limb 3. It is the award that would otherwise apply but for the existence of the CNEA and SOHEA."
(1) the words: "(Relativity to classification C10 of the Metal Industry Award [x]%" in cll 3.8, 3.9, 3.10, 3.11, 3.12, 3.13 and 3.14 should be deleted as being obsolete for the reasons discussed above in respect of the Miscellaneous Workers - Kindergartens and Child Care Centres, &c. (State) Award;
