2. The verdict in favour of the respondent be set aside and in substitution therefore, there be a verdict in favour of the appellant in the sum of $43,568.02 plus interest reduced by 50 per cent for contributory negligence.
1. This is an appeal from a decision given on 9 March 2005 by Magistrate Somes.
2. The claim upon which his Honour (then his Worship) adjudicated was for damages for personal injury sustained in a traffic accident. Relevantly, the facts as found were unchallenged. On 7 September 2003, at about 8.30 pm, the appellant was standing (or crouching) on the carriageway of Burkitt Street, Page in the Australian Capital Territory.
