s.185 - Enterprise agreement
Application for approval of the Southwest Enterprise Agreement 2025
[1] On 21 July 2025, SRG Global Integrated Services Pty Ltd (the Applicant) made an application to the Fair Work Commission (the Commission) under section 185 of the Fair Work Act 2009 (Cth) (the Act) for approval of an enterprise agreement titled Southwest Enterprise Agreement 2025 (the Agreement). The Agreement was made between the Applicant and its employees covered by its scope.
[2] The application was the subject of a procedural decision,[1] in which it was noted that both the Communications, Electrical, Electronic, Energy, Information, Postal, Plumbing and Allied Services Union of Australia (the CEPU) and the Australian Manufacturing Workers' Union (the AMWU) sought to be heard in relation to concerns over the Agreement.
[3] The CEPU withdrew its objection following an undertaking provided by the Applicant. The AMWU's concerns remained.
[4] The issues in dispute between the Applicant and the AMWU were briefly summarised in the prior decision.[2]
[5] I determined, pursuant to section 590(1) of the Act, that the AMWU should be heard on the application and the matter was programmed for Hearing which was listed for 24 October 2025.
[6] Prior to the commencement of the Hearing, the parties confirmed that an agreement had been reached and, shortly thereafter, a further undertaking was provided by the Applicant.
[7] In light of the further undertaking, the AMWU withdrew its objection to approval. The parties were then notified the Commission would turn to consider approval of the application.
[8] The Applicant has provided two written undertakings. Copies of the undertakings are attached to the Agreement. I am satisfied that the undertakings will not cause financial detriment to any employee covered by the Agreement and that the undertakings will not result in substantial changes to the Agreement.
[9] In compliance with section 190(4) of the Act, the bargaining representative's views regarding the undertakings proffered were sought. They were provided with the opportunity to raise and address any objections they had to the undertakings proffered. No objection was raised.
[10] Subject to the undertakings referred to above, and on the basis of the material contained in the application and accompanying declarations, I am satisfied that each of the requirements of sections 186, 187, 188, and 190 of the Act as are relevant to this application for approval have been met.
[11] The Agreement is approved and, in accordance with section 54 of the Act, will operate from 31 October 2025. The nominal expiry date of the Agreement is 24 October 2029.
