McPHERSON JA: The applicant for leave to appeal against sentence was driving a car at about 4.30 in the morning in the Murgon area. The vehicle went off the road and crashed, and he and his companion, Kelly Norfield, went to hospital where the applicant received stitches. They then hitch-hiked to Gayndah where they were found by the police on the same day.
The applicant was brought before the Stipendiary Magistrate at Murgon where he pleaded guilty to driving without a licence and to failure to report an accident. In respect of those offences he was dealt with by the Magistrate on that occasion and in addition was charged before the same Magistrate with two further offences.
