Introduction
- These reasons deal with an application by the defendant for summary relief.
- The grounds for pursuing that application are twofold: first, the allegations made by the plaintiff are - quite simply - fantastic and do not disclose a cause of action and, further, despite a relevantly unfettered grant of leave to permit the plaintiff to replead a claim against the defendant granted by Campbell J on 17 July 2023, the plaintiff has failed to file or seek leave to file any revised pleading; and, secondly, that the proceedings are frivolous, vexatious or an abuse of the process of the Court.
