Judgment
- COMMISSIONER: Sell & Parker Pty Ltd (the applicant) operates a large scale metal recovery and recycling facility (MRRF) at 23-43 and 45 Tattersall Road, Kings Park (the site). The applicant is seeking to increase the throughput of the MRRF.
- On 17 September 2020, the applicant lodged a State significant development application (reference number: SSD-10396) with the Minister for Planning (the first respondent) under s 4.12 of the Environmental Planning and Assessment Act 1979 (EPA Act). SSD-10396 seeks the grant of consent for the expansion of scrap metal throughput of the MRRF from the currently approved level of 350,000 tonnes per annum (tpa) (approved under SSD-5041, as modified) to 600,000 tpa (the proposed development).
- SSD-10396 has not yet been determined, it is the deemed refusal of SSD-10396 which is the subject of these proceedings.
