Judgment (1160 paragraphs)
- For the reasons that follow, subject to any defence available to the plaintiff under s 588H, the plaintiff has established a contravention by the defendant of s 588G.
- Only 5 witnesses were called in the trial. The parties relied mainly on documentary evidence.
- All witnesses gave their evidence in chief by way of the tender of witness statements. Thus any impressions of the witnesses' demeanour were formed in their cross examination. The plaintiff, the defendant and the first third party each gave evidence in their respective cases.
