JUDGMENT
- On 21 April 2021, Sandhu Construction Group Pty Limited ('the defendant') entered a plea of guilty to an offence under s 32 of the Work Health and Safety Act 2011 (NSW) ('the Act'). That offence relates to a failure to comply with their duty under s 19(1) of the Act, to ensure, so far as reasonably practicable, the health and safety of workers while at work, and in failing to comply with that duty, exposing workers, in particular Mr Lovepreet Singh ('Mr Singh'), to a risk of death or serious injury.
- The maximum penalty relevant to the defendant for an offence under s 32 of the Act is $1,500,000.
- The prosecution relied upon a Prosecutor's Tender Bundle ('PTB') marked Exhibit A and a Victim Impact Statement ('VIS') marked Exhibit B. The defendant tendered no evidence.
