Ryan v Moreland CC [2007] VCAT 119
The order of the Tribunal dated 10 October 2005 is corrected under the provisions of Section 119 Victorian Civil and Administrative Tribunal Act 1998 as follows:
By adding the following secondary consent condition to the order.
The development and use as shown on the endorsed plans must not be altered without the written consent of the Responsible Authority.
1 By order dated 10 October 2005 the Tribunal directed the grant of a permit in Permit Application No. MPS2005/0065 under the Moreland Planning Scheme.
2 By letter dated 27 October 2006, Minter Ellison drew the Tribunal's attention to what they suggested was a clerical error within the Tribunal's order, and submitted that the order should be corrected to include a secondary consent condition.
3 Section 119 of the Victorian Civil and Administrative Tribunal Act 1998 provides for the correction of orders where, among other things, there has been a clerical mistake.
4 I am satisfied that this has occurred here and find it appropriate to authorise a correction of the order.
