1 This is an appeal from a decision of a learned Deputy President which concerns his conclusions in respect of a review purportedly conducted pursuant to s 39(2)(a)(i) of the Workers Rehabilitation and Compensation Act 1986.
3 The appellant, the Royal Adelaide Hospital ("the employer") employed the respondent George Khammash ("the worker") as an orderly. The worker was classified under the applicable Award, the South Australian Government Health Etc Ancillary Employees Award, as a Health Ancillary Employee Level 2 ("HAE 2"). Pursuant to that classification and pursuant to the terms of his contract of employment he could have been employed as an orderly or as a porter. In fact he only worked for the employer as an orderly.
