Ross & Anor v Mt Alexander SC [2011] VCAT 2108

This proceeding was an application under Section 82 of the Planning and Environment Act 1987 brought by Andrea Ross and Alexander McKay seeking review of a decision by the Mount Alexander Shire Council to refuse to grant a permit in application no. PA204/2010.
During the hearing in August 2011, the Respondent made an application for costs. In my order varying the Council's decision, I commented upon the costs application and gave directions with respect to any costs application. Subsequently, a costs application was filed on behalf of the permit applicant and a response was filed on behalf of the Applicant for Review. I have considered all of the submissions made by the parties with respect to costs and have found no need for a hearing to be conducted[1].
