- The Applicant is a 'prohibited employee' within the meaning of s 35A of the Motor Car Traders Act 1986 ('the MCT Act') and hence cannot be employed by a motor car trader in any customer service capacity. He is designated as a 'prohibited employee' because he falls within the scope of paragraphs 35A(1), (ab) and (b) of the MCT Act, which state:
