(a) failed to pay rent amounting to $13,383 for the month of November-December 2025 (the November Rent);
(b) failed to pay charges or outgoings totalling $80,348.46, comprising:
(i) water usage of $4,336.32;
(ii) owners corporation levies and council rates totalling $76,012.14.
It is common ground that on an application for an interlocutory injunction, the Court will need to determine whether there is a serious question to be tried as to the plaintiffs' entitlement to relief; whether the balance of convenience favours the granting of an injunction, including whether the plaintiffs are likely to suffer an injury for which damages will not be an adequate remedy; and whether there are any discretionary considerations which weigh for, or against, the grant of relief. These questions must be examined together. An apparently strong claim may lead a court more readily to grant an injunction where the balance of convenience is fairly even. A more doubtful claim, which nevertheless raises a serious question to be tried, may still attract interlocutory relief if there is a marked balance of convenience in favour of it.[4]
(a) water usage charges amounting to $4,336.32 appear to have been levied in August 2025;
(b) council rates, or at least some council rates, appear to have been levied on 1 July 2025. For example, the most recent rate statement from Maribyrnong City Council is dated 14 October 2025; and
(c) a significant proportion of the owners corporation levies were raised after 1 July 2025.
