Application under s 79 of the Planning and Environment Act 1987 for review of the failure of the responsible authority to grant a permit within the prescribed time.
Residential 1 Zone and subject to a Significant Landscape Overlay (Schedule 5) under the Nillumbik Planning Scheme.
Almost rectangular parcel of land with a frontage of 59.42m to the north side of Bridge Street, a depth of 49.86m and an area of 2833m2.
Lot 3 on plan of subdivision No. 344599L being the Land and Certificate of Title Volume 10297 Folio 012 and Lot 1 on Title Plan 125121P being the Land in Certificate of Title 11005 Folio 744.
This is a review of the failure of the responsible authority to grant a permit. However, the planning and building committee of the council, under delegation, determined that it would have refused to grant a permit on the following grounds:
5. The intensity and design of the development, combined with the constraints of the existing infrastructure, does not lend itself to entirely accommodate all car parking (resident and visitor) on-site, which will contribute to traffic congestion and parking issues along Bridge Street.
At the commencment of the hearing application was made on behalf of the applicant to substitute amended plans denoted as "version C" circulated on the cover of a letter 20 Januray 2011. These plans were marked as exhibit M1 and the permit application was amended to subsitute the M1 plans. That amendment was made by consent.
The original permit application was made in the name of Ian Reid but the application for review gives the name of the applicant as Ikonomides Reid. This is an application for review under s 79 of the Planning and Environment Act 1987. Only the permit applicant has the legal right to apply for such a review. It follows that the name of the applicant for review must match that of the name of the permit applicant. This matter was dealt with, in the course of the hearing, by an amendment, made by consent, to substitute the name "Ian Reid" as applicant for review.
