Terms and Conditions for Permit 85/2010/10FP (91 Bridge Street, Eltham)
The removal of one tree from the land (Red Gum), generally in accordance with the endorsed plans.
Terms and Conditions for Permit 766/2009/10FP (16 York Street, Eltham)
The removal of one tree from the land (Desert Ash), generally in accordance with the endorsed plans.
[1] The Council thought that a second Desert Ash tree in the south-west corner of the property also required removal. At the hearing, Mr Reid clarified that this tree would not be affected by his proposed drainage works and therefore permission for its removal is not being sought. A third smaller Desert Ash tree close to the subject tree is of a size that does not trigger a permit requirement.
[2] Planning Permit 498/2007/14P issued in February 2008 and recently extended until 18 February 2012. Alternatively, the drainage works may be required to service an as-yet unapproved multi-dwelling proposal.
[3] At the hearing, Mr Paynter sought to be joined as a party to P903/2010, which was opposed by Mr Reid. I declined to join Mr Paynter as a party but I have however taken into account submissions he made about the subject tree in his capacity as an interested person.
