The appointment of judicial officers for fixed terms does not deny their court that character. In Forge v Australian Securities and Investments Commission [(2006) [2006] HCA 44; 228 CLR 45)] at 59 Gleeson CJ referred to the reference by Le Dain J in Valente v The Queen [1985] 2 SCR 673 at 698 to "tenure, whether until an age of retirement, for a fixed term, or for a specific adjudicative task, that is secure against interference by the Executive or other appointing authority in a discretionary or arbitrary manner". Other matters aside, the availability of judicial review in relation to the process of removal under the QCAT legislation ensures that protection, should it become necessary.
