Note: The form of the order is subject to the entry in the Court's records.
Note: This copy of the Court's Reasons for judgment may be subject to review to remedy minor typographical or grammatical errors (r 10.14(b) Federal Circuit and Family Court of Australia (Family Law) Rules 2021 (Cth)), or to record a variation to the order pursuant to r 10.13 Federal Circuit and Family Court of Australia (Family Law) Rules 2021 (Cth).
Part XIVB of the Family Law Act 1975 (Cth) makes it an offence, except in very limited circumstances, to publish an account of proceedings that identify persons, associated persons, or witnesses involved in family law proceedings.
IT IS NOTED that publication of this judgment by this Court under the pseudonym Ragni & Carrera been approved pursuant to subsection 114Q(2) of the Family Law Act 1975 (Cth).
(1) Whether Ms Carrera should have sole parental responsibility and decision-making for X, or whether there should be an order for shared parental responsibility.
(2) When X's overnight time with Mr Ragni should commence.
(3) How X's time with Mr Ragni should progress, including whether it should progress to four nights a fortnight or equal time and how quickly it should progress.
(4) How X's school holiday time with Mr Ragni should progress and, in particular, when a half school holiday arrangement should be reached.
(5) What orders, if any, I should make in relation to overseas travel.
It is important, in our view, not to confuse what has been said by the High Court and the Full Court as to the obligations on a trial judge to make positive findings of fact in relation to allegations of abuse or sexual abuse against a child where parenting orders are sought and where the test to be applied is "unacceptable risk", with the circumstance in a parenting case where allegations have been made of domestic violence and/or assault by one party upon another. In the latter case it will be necessary for the Court to make findings where the evidence enables that to be done.
a trial judge may not be obliged to resolve all disputed allegations of historical violence between parties, where the resolution of such disputes could not bear on the ultimate disposition: Pickford per Austin & Williams JJ at [80].
I agree that it will not always be possible for a trial judge to make findings and a trial judge is permitted to reach that conclusion. However, when the allegations of violence relate to objectively serious incidents over an extended period and resolution of the dispute is central to the case advanced by a party, the ICL and the intervenor, the determination of the dispute becomes an essential element of disposition of the competing applications.

Definition of family violence and the task of fact finding
4AB Definition of family violence etc.
(1) For the purposes of this Act, family violence means violent, threatening or other behaviour by a person that coerces or controls a member of the person's family (the family member), or causes the family member to be fearful.
(2) Examples of behaviour that may constitute family violence include (but are not limited to):
(a) an assault; or
(b) a sexual assault or other sexually abusive behaviour; or
(c) stalking; or
(d) repeated derogatory taunts; or
(e) intentionally damaging or destroying property; or
(f) intentionally causing death or injury to an animal; or
(g) unreasonably denying the family member the financial autonomy that he or she would otherwise have had; or
(h) unreasonably withholding financial support needed to meet the reasonable living expenses of the family member, or his or her child, at a time when the family member is entirely or predominantly dependent on the person for financial support; or
(i) preventing the family member from making or keeping connections with his or her family, friends or culture; or
(j) unlawfully depriving the family member, or any member of the family member's family, of his or her liberty.
(3) For the purposes of this Act, a child is exposed to family violence if the child sees or hears family violence or otherwise experiences the effects of family violence.
(4) Examples of situations that may constitute a child being exposed to family violence include (but are not limited to) the child:
(a) overhearing threats of death or personal injury by a member of the child's family towards another member of the child's family; or
(b) seeing or hearing an assault of a member of the child's family by another member of the child's family; or
(c) comforting or providing assistance to a member of the child's family who has been assaulted by another member of the child's family; or
(d) cleaning up a site after a member of the child's family has intentionally damaged property of another member of the child's family; or
(e) being present when police or ambulance officers attend an incident involving the assault of a member of the child's family by another member of the child's family.
44 The definition identifies certain behaviour that may fall within the definition, namely, violent, threatening or other behaviour that coerces or controls a member of the person's family or causes the family member to be fearful. Violent behaviour or threatening behaviour are stand-alone behaviours that fall within the definition of family violence. Such behaviours may coerce or control or cause fear, but it is not essential. It might be, for instance, that a female punches her male partner but the punch neither coerces nor controls nor causes the male to be fearful. The behaviour may nevertheless be an act of family violence.
...
46 In fulfilling the onus of proving an allegation of family violence that involves behaviour that coerces or controls, it is not necessary to prove the alleged perpetrator intended the behaviour to be so. That does not mean that intention is irrelevant, but it is not dispositive. A person who engages in such behaviour may be completely oblivious to the impact of their behaviour or they may believe that they are acting in such a way to protect the other family member. Notwithstanding that subjective belief, the behaviour may nevertheless coerce or control the other family member and fall within the definition of family violence.
47 The focus of the fact finding process is on the behaviour and the impact of the behaviour. It is the behaviour that coerces or controls. It requires action and reaction. A single act is unlikely to be coercive or controlling but it may be. Behaviour that coerces or controls may be innocuous, subtle, capable of different interpretations, complex, undermining, etc. Such behaviour may create impossible expectations for the other family member. It may be transactional and involve punishments for perceived failures. The impact of the behaviour can be insidious. A confident and happy family member may lose their confidence, their self-esteem, question their sanity, shun their family and friends, become depressed, irritable, inefficient, and unhappy. There may be times when they strike out either verbally or physically.
48 When determining an allegation that a person has engaged in behaviour that coerces or controls a family member, a trial judge will undertake a forensic examination of all relevant evidence to:
(a) identify the behaviour about which complaint is made;
(b) identify the full context of the behaviour including any explanation that may be given by the alleged perpetrator;
(c) identify the impact of the behaviour on the alleged victim (mere assertion by the alleged victim that they feel coerced or controlled is insufficient);
(d) make all relevant factual findings; and
(e) explain why the behaviour in question is or is not family violence that coerces or controls the family member and if the alleged behaviour does not entail a course or pattern of conduct, explain how the behaviour can nevertheless be characterised as behaviour that coerces or controls, if so found.
49 Once such behaviour has been identified it is then a question of what weight is to be given to it and any impact on the orders under consideration.
50 The definition of family violence is necessarily broad and any interpretation that may be perceived to, or actually, create unnecessary hurdles to an alleged victim proving an allegation of family violence should be avoided.
51 Whilst the key feature of coercion or control is that a person is induced (many other words are also apt here) to do as the other wishes, the statutory focus is simply on behaviour that coerces or controls and not the intention of the perpetrator.
52 ... the finding that there is coercive or controlling behaviour is an evaluative one, having regard to all of the circumstances and all of the evidence before the court. Whilst patterns of behaviour may be particularly illuminative, they are not essential. Importantly, for present purposes, the trial judge does not need to spend time and trouble searching for an inference that there is an intention to coerce or control. It is sufficient simply to apply the words of the statute without embellishment and assess whether there is behaviour that coerces or controls.
The ADVO and assault proceedings were heard in the [...] Local Court [in mid] 2022 and [late] 2022. It was extremely stressful for me. The police did not tender the photographic evidence of my injuries and nor did they raise the history of domestic violence. Prior to giving evidence [Mr Ragni's] sister, [Ms O] and her boyfriend [Mr S] stared and pointed in my direction. Their behaviour caused me to feel extremely intimidated. I was cross examined for over 3.5 hours and found reliving the incident of [...] September 2021 through cross examination to be traumatising. Counsel representing [Mr Ragni] used an affidavit filed by me in these proceedings as part of the cross examination in the criminal proceedings. I did not give permission for [Mr Ragni] to use my family law affidavit in the criminal proceedings.
To the single expert, Ms Carrera said the following when asked about Mr Ragni's summation of her evidence in the criminal proceedings, including that she did not present as a credible witness and that she appeared to be giggling or laughing:
She said she did not remember behaving in this manner and she was taking the criminal proceedings seriously. She said that if she laughed it may have been a laugh of incredulity [which she demonstrated], or a nervous laugh. She said it was gruelling and exhausting having a very long cross examination at a time when [X] was only four months old and was very unwell. She described the cross examination as brutal, terrifying, horrific and awful. She said that despite the conclusion of the criminal trial, she knows that [Mr Ragni] was violent towards her and that he knows it too. She pointed out the deficiencies in the police prosecution.
I have had to assess the evidence before me and make my own findings, including as to credibility. Given the state of the evidence about the other proceedings, I do not attach any significance to the fact that criminal charges against Mr Ragni were dismissed, as was the ADVO, nor to the fact that another judicial officer found Ms Carrera not to be a credible witness.
He denied that he had posted any direct messages to [Ms Carrera] himself and that he would not do so because of the ADVO. However, he said he would make general posts on his Instagram, such as posting that he was at a walk or a hike and that she would post a message in response to his general post.

Right. Can you turn to the next page. 1153:
Cravings for me or dessert?
? Yes.
Do you accept you posted that one? This is a picture from our honeymoon. I can't think of a context where I would write that. Yes.
My question was? Post that. Yes.
did you post this or you're not sure? This one, I'm pretty sure I didn't. Yes. No.
You accept it - I mean, I think your evidence just a moment ago is that this is a picture from your honeymoon? Yes.
is that right? Yes, that's right.
Right. And this is a picture that you had on your mobile phone? Yes, that's right. Yes.
And that it says:
Cravings for me or dessert?
? Yes, that's right.
Right. If you did post it, you would accept that this is directly relevant to my client. Noting the subject matter of the picture and the comment underneath the picture. Isn't that right? Yes.
And that's the reason you're saying to her Honour, that you don't think that you posted it. Because you know it would be a breach of the AVO. Is that right? No. That's not the reason why I'm saying I didn't post it. I'm saying honestly because I don't recall posting it.
And by saying you don't recall posting it, you're indicating there's a possibility you did post it? Yes. But I would usually remember if I posted it. So I'm pretty sure - like, yes. I will say, I know I didn't post it. Yes.
This was posted [in] 2022? Okay
And do you accept that you posted this one? No, I don't. I - yes. No.
You didn't post it? No. Yes.
one concern would be that the father, in response to that direct question of mine, minimised his own involvement. You know, his own participation, if you like, in that communication, and sought to effectively blame the mother - if I can call it that - for provoking - provoking is the wrong word, but trying to elicit the sort of loving response at a time when she was also a protected person under the ADVO. So it would actually ultimately discredit her. And if what you're saying is accurate, he minimised to me his own role in that. So, yes ... that would be a subtle, perhaps, example of him attempting to discredit the mother.
"a traumatic event has that impact on the formation of memories"
"'[d]ue to the potential for cuing of emotional responses to fragmented memories, memory can change, be subject to the reconsolidation effects, and even when these effects are not marked initially, memories may remain labile for some time (thus changes in what the person reports as their memory of an event can be expected)'" (Lehrmann at [117(2)]);
"a lack of clarity and confused accounts can be expected until such time as the memory has consolidated after - this is after a traumatic event." (citing Lehrmann at [117](3)]);
"'after a traumatic experience, that 'inconsistencies in reporting following a traumatic event are often observed and explicable through underlying theories of trauma and memory function'" (Lehrmann at [117(3)]);
"That 'omissions can be understood as alterations in awareness due to high arousal at the time of the event that consolidate over time'" (Lehrmann at [117(4)]);
"That inconsistency is often observed in reliable reports, in this case it was of a sexual assault, and is not ipso facto a measure of deception - that is not just in relation to sexual assault matters, but traumatic events more generally" (citing Lehrmann at [117(6)]);
"... 'in understanding the account of an alleged "survivor", a person must consider how the account was elicited; this includes the skill and attitudes towards the person by the investigating officers; the time elapsed between the time of the event and the formal interview; and the psychological/emotional state of the person being interviewed at the time of the interview'" (Lehrmann at [117(7)];
"'the first forensic interview is potentially a trigger for intrusive thoughts that can lead to fragmentation of memory and disassociation; patterns of behaviour such as high confidence and clarity in the account are not helpful in determining whether the account is accurate'" (Lehrmann at [117(8)]);
"'despite the belief that the emergence of inconsistencies across interviews is a sign of lying (people "can't keep their story straight") ... the literature on memory, impacts of trauma and the dynamic between interviewee and interviewer must be considered'" (Lehrmann at [117(9)]);
"'multiple interviews are typically necessary to construct a clear narrative of the events; however, the consequence of these multiple interviews may be patterns of inconsistency or omission[s] especially early in the interview process (which need to be carefully evaluated but are not in and of themselves necessarily indicative of deception or accuracy)'" (Lehrmann at [117(10)]).
And it's a fact, isn't it, that on 23 June, you took issue, that is you raised clearly with [Mr Ragni] that he needed to take responsibility for his conduct? I don't recall dates, but it could be a conversation that we've had.
And that you indicated that he had to not use bad language or rude words; that's something you've raised with your brother, isn't that right? I don't
MR OTHEN: Well, I object. It's just if we could be clear as to when, was that ever or on 23 June?
HER HONOUR: Yes, if you could just pin that down please, Doctor.
DR BARNETT: Yes, on 23 June? What - is there like a situation that was happening in?
So this is when you're at the maternal family home, that's what I'm putting to you? The same - that same
That you raised with him in this family conversation, that he has to be more respectful? I think it was a conversation that everybody needs to be respectful.
And that part of that was that he had to tailor, that is, change the language that he used, not use bad words? I don't recall details, but I know it was just a conversation that everybody needs to respect each other - both parties.
Now, in this affidavit, you say this, "They argued," and you're referring to my client and the father and him using bad language. What examples do you have about him - that is, the father - saying to my client - using bad language? I can't recall correctly, but if we were present, there's no way that he would have sworn. And there was other people.
Well, ma'am? It could have been like, "Shut up," or something like that, to that extent, but I don't remember name-calling. Definitely no name-calling. No using the word - you know, to - no "bitch", no "slut", or nothing like that. No.
So other than saying, "Shut up," as an example of what your brother said to my client when they argued, do you have any other examples? Not that I recall, you know, directly, but it could have been like, "Fuck off," or, "No, shut up." That's - and I consider that bad language.
Mr Ragni's evidence about Ms Carrera's behaviour
I have carefully considered the father's assertion that the mother has a significant mental health disorder which caused her to engage in self-injurious behaviour and physical violence towards him. There is no evidence available to me that the mother has behaved in this way in any other context, including in other relationships, in her career or professional relationships and long-term friendships or in other situations. There is no indication in the mother's medical history that she has had any history of self-injurious behaviour and there is no evidence that the mother has ever had a formal thought disorder or suffered from a psychosis that would indicate that she would cause harm to her infant.
Dr C opined that there is nothing in the material that supports a diagnosis of a personality disorder and she opined that "there was no indication in [X]'s behaviour, presentation, or manner that she has been exposed to anything other than stable, consistent, caring parenting by the mother".
When we got to the car I sat inside, and [Mr Ragni] became extremely agitated and banged my side of the car door so hard that a water bottle held in the car door fell on my feet. I was shocked at his behaviour. He had never acted this way before. When [Mr Ragni] got into the car, I turned to him and the following conversation occurred:
I said: "Why are you being so rude to me, I never lost the gem on purpose".
[Mr Ragni] yelled and said: "You deserved this behaviour, you are so careless"...
I was scared of how angry [Mr Ragni] was, so I got out of the car and [Mr Ragni] drove off, leaving me in the carpark. It was approaching midnight, so I called my brother [Mr N] to get me. I was very upset by this incident and was in tears by the time I got home. I felt scared of [Mr Ragni] and his level of anger towards me...
As I began driving away, [Ms Carrera] jumped out of the moving car whilst still in the carpark. I observed that she began to shake in anger before bolting off in a rage. I waited in the car park not knowing what to do. My phone then rang and I recognised [Ms Carrera]'s voice. She said: "There is a creepy guy following me, trying to touch me. Come and save me". I drove to where [Ms Carrera] indicated she was. I found her sitting in an empty restaurant at a table, shivering. I didn't see a man anywhere. I said: "Come on let's go". [Ms Carrera] said: "I have already called my brother and he has left home". I said: "Well hop in my car until your brother arrives" which she did. Upon [Mr N] arriving to collect [Ms Carrera], I could hear [Mr N] yelling: "Fuck this guy, I hope I never see him again!". I left after they left, returning to my home.
When I collected [Ms Carrera], she was very upset with tears running down her face and she said to me words to the effect of "I was so scared because [Mr Ragni] was shouting and very angry. I was so scared, so I got out of the car. He then drove off. I have never seen him like this before".
Mother: Ok
Mother: Sorry
Mother: This all shouldn't be happened
Mother: There's nothing literally nothing wrong.
Mother: And I wasn't even ignoring you
Father: I know that's the worst part
Mother: You were just really rude n arrogant to me which I didn't like
Mother: You don't respect
Mother: Rolling your eyes n your tone changes
Mother: You talked very rudely
Father: [Ms Carrera] given the way you stormed off like that I won't accept nothing was wrong on your end.
Mother: That was my reaction to how you behaved to me [Mr Ragni]
Mother: i try to forgive all the time but it's getting worse
Mother: You're in your defensive mode again
Mother: You always think worst about me
Father: I will send you the video. I have listened.
Mother: If its like this and you don't care about me then this is not good
Mother: Seriously
Mother: That's why you wanted me to talk near your car?
Mother: So you can record ever
Mother: Everything
Father: No
Father: But I didn't think I was rude. All I said was why are you ignoring me and you started to say stop the car.
Mother: That's all your camera recorded?
Father: Your behaviour is serious too. When we have kids inshallah will you do the same?
Father: It has the entire two minutes that's all I saved. Once you listen I will delete. The whole thing was under two minutes
Father: [Ms Carrera] - it's not to blame or anything, we need to learn from this
Father: If I was rude then you can show me and I will apologise. Vice versa.
Mother: Sure, send me this video now.
Father: No, it's in the app. I won't download it onto camera roll. I won't circulate it. Once we listen together, we delete it then and there.
Mother: Send it to me now
Father: Sorry I won't. Like I said, it's not coming off the app. I don't want this existing.
Mother: You really think you were not rude to me?
Mother: ?
Mother: Sorry [Mr Ragni] i am not like who records everything we spoke about and therefore you avoid **cut off**
Mother: That's why you asked me to sit near your car so you can record
Mother: Near your feet
Father: No I genuinely wanted to be there with you. I couldn't believe what just happened
Father: [Ms Carrera] I'll delete it if you want. That's the only one I downloaded.
Mother: Don't know what happened in your past relationship I never asked you
Mother: I don't think i can live my life like this
Mother: Recording all the conversations
Mother: I am sorry but I can't continue like this
Mother: I don't think i can go ahead anymore
Father: You have to physically go in and download it. I only downloaded these videos. The rest will get over written. If you don't believe me then I don't know. I show you all the crash ones
Father: So I will delete these as well
Father: Mentioning my past relationship is pretty low.
Father: If you think I'm a lier - well I can't change that
Mother: Sorry i can't live my life like this
Mother: You recorded everything
Father: I'm not hiding anything
Father: It's what dash cams do
Mother: I can't do this
Father: Your choice
Father: It's just a silly act so you can break up. I will still love you.
Mother: I can't do this.
Father: Why cause you're confronted with the truth? All the lies in your head about me are not true
Mother: Really [Mr Ragni]
Father: Yes.
Mother: ?
Mother: Really?
Mother: Why don't you send me all those videos now
Mother: Really?
Mother: Why [Mr Ragni]? You do you hate me this much?
Father: I don't
Mother: I am going away from your life.
Father: Please don't
Mother: I can't do this
Mother: I am really scared of you now
Father: Me too
Mother: Please forgive but i never had any bad intentions. I genuinely love you and wanted to be your wife and keep you happy and take all your pain away
Mother: That's all
... [Mr Ragni] regularly recorded me on his phone, even though I asked him not to. During these proceedings I have also become aware that [Mr Ragni] has taken video recordings of me without my knowledge or consent.
... it took [Mr Ragni] many months to remove one of the dash cameras [from his car] and he refused to remove the other one, despite knowing I did not want to be recorded.
I consider recording me without my consent or knowledge to be harassment and a breach of trust between husband and wife.
During cross-examination, Mr Ragni agreed with the proposition that recording someone without their consent can be intimidating but said that he had removed the dashcam at Ms Carrera's request.
...[Mr Ragni] was texting his friends and I interrupted him as we had the dinner planned for the same evening and I wanted to make sure we did not run late. [Mr Ragni] began to get angry. [Mr Ragni] pushed me against the bed so hard causing me to injure my foot. It bruised and I struggled to walk. [Mr Ragni] said to me words to the effect of "I am sorry for hurting you, but you can't seriously be in that much pain" and "You are not to discuss this with your friends at dinner".
On this night a last-minute dinner was scheduled for [Ms Carrera] and me to attend a restaurant at [Suburb T] to celebrate one of [Ms Carrera's] friend's birthdays. [Ms Carrera] asked me: "what should we get" (as a present). I suggested "a $150 [store] gift card". We were also taking him and his wife for dinner and having them back to our apartment for cake, tea and coffee. [Ms Carrera] was a little unsure because she told me: "[Mr U] and [Ms V] (who were also joining us) have bought him a [expensive gift]". She took offence to me when I said "I think you're doing too much". I thought the things above were substantial gifts.
[Ms Carrera] then left to go to the cake shop, [the store] for the gift voucher and Coles for candles. When [Ms Carrera] got home, she started pushing me and screaming things like "you're jealous of my friends, you hate them", and started chasing me around, and kicking and thrashing about uncontrollably. In the process, she hurt her foot, on what I do not recall. She eventually calmed down, and we went to dinner...
"He insults me."
"He was rude in New Zealand as well."
"He fights all the time."
"He pushed me, my foot ligament tore, he always abuses me and said he has become a poor person because of me."
"He says I'm a psycho wife."
"When I said I will call my brother, he pushed me again."
"We went to hospital in emergency and did an xray (sic). It is not a bone fracture."
"He says I didn't push you, you were kicking yourself".
"He said I didn't do it, you did it yourself".
"In front of everyone, he is really good, but he is rude and he is hiding things".
M: Once he did it, he hit me on my foot; I had to go to [hospital] because he hit me so badly. It was on my foot.
P: What was the injury on your foot?
M: A muscle was ruptured or something so I had to go to [hospital].
P: And how did he do that?
M: He hit me and th-
P: Like how did he do that, did he punch, or-
M: Yeah he was hitting me and then my foot hit the bed ...
On 19 June 2021 [Mr Ragni] and I attended his friend's house in [Suburb W] for a catch up. Throughout the evening [Mr Ragni] and his friend were in a corner whispering. On the way home [Mr Ragni] whilst driving the car shouted angrily at me "shut up" and snatched my mobile and threw it. He stopped the car and said "get out now". I got out of the car as I was fearful and started walking in the dark. [Mr Ragni] wound down his window and called out loudly to me "why did you walk in this street. You are a hooker and a slut". I started crying and said "please return my mobile. I want to go back to my family's house". After several minutes [Mr Ragni] said "fine I will take you home to your family". I got back in the car expecting to go to my family's home, but [Mr Ragni] instead drove me to the [Suburb Y] unit.
After the above incident I made several calls to my family without [Mr Ragni's] knowledge informing them of what had occurred and that I had thoughts of leaving.
[Ms Carrera] has further alleged that on 19 June 2021 I again became aggressive and left her in a dangerous position. I recall that [Ms Carrera] and I attended my friend [Ms R]'s home. The boys were on one side of the room, joking and laughing. [Ms Carrera] then came over and was angry. She said: "Why are you making fun of me" and "Why are you whispering about women?". We weren't doing either, but her questioning made me feel uneasy as I could tell [Ms Carrera] was becoming angry again. When we left, a short distance from [Ms R]'s house, [Ms Carrera] jumped out of the moving car and then thumped my car really hard. She then walked up a dark street in a really unsafe part of [Suburb W]. Two men approached from the other direction and she came back. [Ms Carrera] was yelling and ranting and hitting the bonnet of the car parked next to us. She eventually got back into the car. Whilst driving home and once returned back to our apartment, [Ms Carrera] hit and scratched me. She refused to exit the vehicle. She said to me: "Drop me at my place or I am going to go to the Police and tell them you hit me!". Eventually [Ms Carrera] returned to the apartment. Given the viciousness of the beating, I knew I had sustained visible injury. I took the photos in the elevator and in the bathroom. Eventually she calmed down enough to come back up into our apartment.
... it was a reaction to being subjected to violence. He gave the example of saying "you bitch, you slapped me" when [Ms Carrera] had hit him. He denied calling the mother a "whore" or making other similar derogatory comments, and said that he only swore in situations where he was defending himself or she had provoked him. He acknowledged that his swearing was inappropriate and said he is not proud of it.
In cross-examination, Mr Ragni denied having called Ms Carrera "a hooker and a slut" or words to that effect.
On or around 20 June and 21 June 2021, I received some telephone calls from [Ms Carrera]. During those calls she was quiet and said words to the effect of "I have to talk quietly because I don't want [Mr Ragni] to know I am calling you. He doesn't like it if I call you". During those calls I recall [Ms Carrera] said to me words to the effect of "It was awful, [Mr Ragni] had been yelling at me and told me to get out of the car. I was standing on the street and [Mr Ragni] sat in his car yelling at me you are a hooker and a slut" and "I'm not really sure what I should do about my marriage". I could hear in the tone of [Ms Carrera]'s voice she was very unsure of what to do and was very upset.
I said to [Mr Ragni]: "What was the argument about?" and [Mr Ragni] responded: [Ms R] has just come back from [Country L] after getting married. We were there to celebrate. The boys were on one side of the room, joking and laughing. [Ms Carrera] then came over angry. She said we were making fun of her and whispering about women. Which we weren't. When we left, a short distance from [Ms R]'s house, [Ms Carrera] jumped out of the car, and then thumped my car really hard and walked up a dark street in a really unsafe part of [Suburb W]. Two men then approached her, and she came back and got in the car. It was dangerous what she did.
[Mr N] , you really need to have a very firm word with [Mr Ragni] about the language he uses. If [Mr Ragni] ever called my sister a hooker or anything, I would kill him and she would leave him.
He needs counselling on his own and not with [Ms Carrera]. You need to be firm about that too with him please.
On 22 June 2021 [Mr Ragni] and I had another argument concerning finances when [Mr Ragni] screamed at me "You fucking get out of my house right now, leave the house". [Mr Ragni] was yelling and recording me on his mobile without my consent. I was fearful for my safety and called my brother to collect me. My brother picked me up that night and took me to my family's home. After I left [Mr Ragni] sent me messages saying that he was sad that I went and he wished tonight did not happen.
I deny what it is asserted I said and did. We were sitting at home and going through my old travel photos on my phone, some of which contained photos with female friends. From that [Ms Carrera] became physically and verbally abusive. She slapped me and scratched my face and hands, and ultimately demanded I take her to her brothers [sic] place or "I'll tell the police (falsely) you were hitting me".
On [...] 2021 I went to [Z Store] to buy a wok and some ingredients to cook dinner for [Ms Carrera] that night. When I came back, [Ms Carrera] started sniffing around my neck and chest and then accused me: "Why did you take so long. Are you cheating on me?" whilst grabbing my throat. She also said "I can end this" pointing to her stomach. Then she started thrashing around, kicking the kitchen cupboards, kicking the coffee table and the dining table, throwing her arms out and behaving in a manner I've never seen in an adult before, but more in the manner of a two year old. She then made a telephone call, and shortly thereafter her brother arrived to collect her and she left the apartment for a week.
On [...] 2021 [Mr Ragni] and I had an argument. [Mr Ragni] complained that the house was not cleaned properly and began pacing up and down the unit getting more and more agitated. I walked into the bedroom and [Mr Ragni] followed me. [Mr Ragni] then grabbed me around the shoulders with both hands and said "Go to Hell". I shouted at [Mr Ragni] "take your hands off me". I returned to the main bed and then [Mr Ragni] kicked and punched me on multiple locations on my thigh, calf area and knee. I shouted out saying "You will kill me and the baby both". I ran into another room and called my brother to collect me. I was shaken and scared that [Mr Ragni] would hurt the unborn child. Whilst at the unit I took photos of the bruising. After I returned home with [Mr N], I showed him the pictures of the bruising I had taken.
On [...] 2021, I received a call from [Ms Carrera] who was extremely distressed and she said to me words to the effect of "Please come and get me, he has started again". I was extremely concerned and left straightaway [sic] to go and collect [Ms Carrera]. I was worried because she was pregnant and [Mr Ragni] was being violent to her. After I collected [Ms Carrera] and brought her home, [Ms Carrera] was crying when she said to me words to the effect of "[Mr Ragni] kept kicking me over and over. I was so scared, I took photos of the bruising". [Ms Carrera] then showed me photographs of bruising injuries in [sic] her legs she had taken on her mobile phone.
[...] bro. I understand you are extremely angry with me. I want to really fix this and save our marriage. You said previously to come and talk with you, I haven't been open enough. But I want to stop being the bad guy and I'm trying to make changes for myself and for the sake of [Ms Carrera] and coming baby. I know it's not a good [sic] for me to come to [Suburb G] but if you could come to [Suburb Y] instead that would be good too?
[Mr Ragni] And just to add, all this anger is ruining the good memories and plans. I hope it changes.
Mr N replied "[n]o one is angry with you. This is your own anger ruining every thing [sic] like always and you know this."
... [Mr Ragni] was screaming at me "Your friends are no good, all they want to do is break our marriage up". [Mr Ragni]'s mother was on a Facetime call and when I tried to talk to her and tell her what was happening, [Mr Ragni] pushed me down causing me to fall into a wall. I said to [Mr Ragni]'s mother "[Mr Ragni] pushed me" but she offered me no help and did not respond. After the call I said to [Mr Ragni] "I am calling my brother to come and get me". [Mr Ragni] responded "No do not call him". [Mr Ragni] snatched my phone from my hand and threw it against the wall. I ran and picked it up and called my brother to collect me. [Mr Ragni]'s behaviour had caused me to become stressed and anxious in circumstances where I was supposed to be on bed rest as instructed by my doctors on 24 July 2021. My brother arrived at the house to collect me.
Over the next couple of days, [Mr Ragni] continued to call me multiple times a day, apologising and asking me to come back. On 1 August 2021 [Mr Ragni] came to the [Suburb G] house to ask me to come back. I said to [Mr Ragni] that "I needed more time and space away from him".
On 3 August 2021, [Mr Ragni] came to [Suburb G] to take me back to the unit. I was worried about returning but also wanted to save our marriage for the sake of the baby. My mum packed us food to take with us for the entire week as I was very weak and was still experiencing morning sickness.
Again, on or around 30 July 2021, I was contacted by [Ms Carrera] who called me and said to me words to the effect of "[Mr Ragni] has been violent to me again, please come and get me". [Ms Carrera] sounded extremely upset and I went and collected her. After we returned home, [Ms Carrera] said to me words to the effect of "[Mr Ragni] pushed me down and [Mrs Ragni] has done nothing to help me. [Mr Ragni] even snatched my phone off me and threw it against the wall, I was so frightened".
On 30 July 2021, at approximately 8.15pm, we went to pick up dinner at the local kebab store. [Ms Carrera] waited in the car. I answered a telephone call. When I entered the car [Ms Carrera] was furious with rage. She insisted: "You are cheating on me!". By the time we returned home, she had lost complete control of herself. [Ms Carrera] threw the food, my mobile phone, and hit me. She was yelling and crying, rambling and pacing, and [Ms Carrera] was knocking into furniture like the coffee table and the television unit. [Ms Carrera] did not this time knock the vase off the television unit, although she had before. [Ms Carrera] paced a loop around the apartment towards the front door, then towards the bedroom and back around through the kitchen. I telephoned her mother to help calm her down. I changed the setting to speaker so [Ms Carrera] could hear her mother. [Ms Carrera] continued yelling and crying. [Ms Carrera]'s mum and I were both talking to [Ms Carrera] trying to calm [Ms Carrera] down. Eventually [Ms Carrera] calmed down. She lay on the sofa and I hand fed [Ms Carrera] dinner (a snack pack from "[the kebab store]"[)]. Later I moved [Ms Carrera] to bed, and continued to hand feed her dinner. [Ms Carrera]'s mother later messaged me: "Thank you beta". "Beta" means Son.
[Ms Carrera] became irate again at approx. 10.45pm. I again contacted [Mrs Carrera]. During the call, I heard the phone be exchanged and then [Ms Carrera]'s brother's voice started yelling at me saying "Look, if she's not going to calm down and not going to stop, just bring her back to [Suburb G]! Do you want me to come? If I come, it won't be good...". I agreed to take [Ms Carrera] back to her mother and brother's home at [Suburb G]. [Ms Carrera] then began to empty out entire cupboards, everything from clothes to appliances. [Ms Carrera]'s folded clothes were in our main bedroom. She collected them in her arms and said to me: "pack these". [Ms Carrera] grabbed armful after armful of hanging clothes from the wardrobes in the spare room, directly off the hook and said to me "Take these to the car". [Ms Carrera] did not seek to pack the items in any form of container or luggage. She collected the juicer, a Dyson hair appliance kit, an electric toothbrush, her toiletries, a computer screen and her lap top computer. I then dropped her home late that night. The entire way, she kept grabbing the steering wheel, slapping me and hitting me. [Ms Carrera] said to me: "Why are you cheating on me?" and "Our marriage is over!". When we arrived at the [Suburb G] house, [Ms Carrera]'s brother, [Ms Carrera] and I unpacked [Ms Carrera]'s belongings from the car.
Over the next few days I did message and call [Ms Carrera] however I felt it was best she stay with her family in [Suburb G] given her erratic behaviour and to prevent any harm to the unborn baby. [In] 2021 was [Ms Carrera's] birthday. I slept over a few nights hoping her health would improve. By this I mean that I observed that [Ms Carrera] stopped yelling, crying and hitting me, she began eating regularly and stopped accusing me of cheating. I also dropped off her medications she sent the electronic prescriptions for.
... I spoke with [Ms Carrera] and [Mr Ragni] if not daily, almost every day. [Ms Carrera] did not tell me that [Mr Ragni] had pushed her against a wall causing her to fall.
On 15 August 2021 [Mr Ragni] was screaming at me about the costs of food and in anger he threw my phone on the wall. I was [...] pregnant and couldn't stop vomiting. I walked into a room to get away from [Mr Ragni]. [Mr Ragni] followed me. I asked him multiple times to leave me alone. I attempted to close the door. [Mr Ragni] suddenly pushed against it with force and I used my hand to stop the door hitting my face. This caused bruising to my hand.
Later that night, when I was sleeping, [Mr Ragni] came and started watching a video on his mobile phone very loudly and woke me up. I asked him what was wrong and he said "watch this video which my therapist sent me to watch". It was 2 am and I said I did not want to watch the video and whether it could wait until the morning. [Mr Ragni] said "no, you have to watch it, my therapist said show this to your wife". I was too tired to argue with [Mr Ragni] and there was no space in the bedroom to sit elsewhere, so I opened the balcony door to sit while [Mr Ragni] watched the video. [Mr Ragni] came to the balcony and apologised. He said "I will not force you to watch the video, come back inside".
On or about 15 August 2021 I asked [Ms Carrera]: "Can you please put on a jumper rather than (wear just a t-shirt and) using the central heating". [Ms Carrera] replied "why did you marry me if you can't afford me".
After this discussion, I went out to get us dinner. [Ms Carrera] directed me "Get me a wrap". I have checked my records regarding purchase of food at El Jannah that night and I have located a receipt on 15 August 2021 for $63.50 which comprised a significant amount of food including two wraps, a chicken, Fattoush salad, tabouli, bread, pickles, and chips. I did cut a small portion of the roll, but also of the chicken, so [Ms Carrera] could have something of everything I purchased. I placed it all on our table for us both to eat...
Upon returning with our dinner in hand, I found that [Ms Carrera] had become enraged. She accused me: "you are trying to starve me and the baby!" She started throwing things in the apartment including my phone and the television remote. [Ms Carrera] could not be convinced by me that there was more than half a wrap in front of her. It was as though she was blinded by her rage. It was very confusing. I began to suspect that she was having a suspected episode of hallucinations or schizophrenia. I could not calm [Ms Carrera] down. I called my mother via Facetime. I then witnessed [Ms Carrera] ram herself against the (metal) frame of the door way multiple times and then lock herself into the spare bedroom and ram herself against the door from the inside.
I believe [Ms Carrera]'s mother called her and then she came out of the office, calmer. Throughout that night her mood did not improve greatly. The following morning, I left the apartment early to try and entice [Ms Carrera] with some fresh fruit and yoghurt for breakfast. When I got back she was gone.
My client didn't ram herself against the door on this day, did she? All I could see was on the screen of, you know, FaceTime, and I could see her running, and she hit the door. Yes, she did.
Now? And then she went inside and slammed the door and sat behind the door, yes.
Well, you don't know where she sat in the room? No. Because she had blocked the - the door. She sat behind it. Because I tried to talk to her and come out and eat and thing, and that's what I thought. That's what -
Okay? Mmm.
So to follow that, [Mr Ragni] takes you on the FaceTime call and moves towards the door? No. He was sitting on the sofa that - I think he was still in the lounge.
Okay? And he just turned his phone to show me that she was running there.
But how do you know the door is blocked? Because the - the door was closed.
Right. But you just gave evidence that she sat down behind the door and that the door was blocked? No. I'm talking about that - she got up -
Yes? and ran towards the door, hit herself against the - I think the - the door - the edge or something, and then she opened the door, went back and slammed it from the - behind her.
And then your evidence just after that, ma'am? Mmm.
was that the door was blocked and that she had sat down? Yes.
Right. And I'm putting to you? But that's what my understanding was, yes.
HER HONOUR: Just wait until the question is asked before you answer anything further? Mmm.
Yes.
DR BARNETT: And is the way that you knew that the door was blocked and that she was sitting down behind the door? Mmm.
is because [Mr Ragni] took you, in the FaceTime on the phone, and went towards the door? It's a very small lounge, and he just turned it. I could only see whatever - the door, and that - that she's there.
And [Mr Ragni] tried to open the door, and it was blocked? No. Nobody - I - nobody was trying to open the door, but I was - remember calling her "[Ms Carrera], come out, come out. Come and - come and eat your food." That - I remember that much. And she didn't.
Ma'am, it was your own evidence a moment ago? Mmm.
that it was blocked and that she was sitting behind the door? That's what I thought that she has done, yes.
The only way? Mmm.
that you would know that the door was blocked and that she was sitting behind it was if the father had gone over to the door and it? Yes. Maybe he would have gone close
HER HONOUR: No, wait. Wait? Mmm.
DR BARNETT: If the father had gone over the door and attempted to open it. Do you accept that proposition? Yes .....
Okay. And then you've just - before her Honour asked you to wait, you were saying, "He may have" and you put your hand out. Were you saying that he may have walked over there and tried to open the door? He just - he did try. He was just - I remember saying that she's not opening the door. Yes, that much I remember.
And so he may have gone over the door and tried to open it. Is that your evidence? That is - no. I didn't - I don't recall anybody pushing the door and trying to open, I think. I don't recall that, or even trying to open the door.
But your evidence is knowing that the door was blocked and that she was sitting behind it - that information may have come about because he may have tried to open the door; is that right? He would have checked. He would have asked her to come out. Yes.
All right, but listen to my question. But he may have gone over to the door and attempted to open it. Do you accept that proposition? I can only answer what I could see on a FaceTime screen, and it's very, very limiting. So asking me this question to specifically say yes or no, I - I - I can't answer this.
Well, I'm asking you a very specific question. The - do you accept the father may have gone over to the door and tried to open it? He was definitely asking her to come out, but I don't know if he did go there and push the door or anything, no.
There was tendered a picture of Ms Carrera's hand with a bruise on it.
On [...] September 2021 [Mr Ragni] and I had been arguing for a long time about finances when [Mr Ragni] shouted at me words to the effect of "you wasted your food by vomiting and I had to spend so much money on it". I went into the bedroom and laid on my back as I was tired. [Mr Ragni] was agitated and followed me to the bedroom. [Mr Ragni] lent over me and aggressively thrust his knee into my stomach multiple times. I held my forearms up to protect myself and my stomach. [Mr Ragni] continued to yell at me and grabbed my arms applying significant pressure. I shouted at him to stop and said I would call my family for help. [Mr Ragni] shouted saying "if your brother comes here to this apartment, I will punch him in his face and break his face and I will break his nose".
Once [Mr Ragni] stopped hitting me, he began to record me and was saying things that were not true, so I recorded him as well to have an accurate account of what was happening. This made [Mr Ragni] even more angry. He pushed me and snatched my mobile phone and said in an aggressive manner "I will smash your phone". I was crying and scared. I was concerned that [Mr Ragni] would hurt the baby and I was in genuine fear for my life. I grabbed my work phone and called the Police. I left the unit as instructed by the 000 operator and [Mr Ragni] started to follow me. I was barefoot and waited on the street until the Police arrived. An Ambulance was called and I was admitted to [hospital] around 2am. I was seen by doctors, nurses and social workers. I showed a social worker photographs I had taken of bruising caused by [Mr Ragni] previously and told her about the history of domestic violence. I also showed the social worker [Ms BB] bruising I had sustained in the assault on my right thigh from the incident on [...] September 2021. I took photographs of the injuries on [...] September 2021 and again on [...] September 2021.
The most serious allegation of violence made by [Ms Carrera] with respect to me, is in relation to an incident which occurred on [...] September 2021. On this night [Ms Carrera] became very angry after I took the rubbish out with my mobile telephone in my possession, accusing me: "You are cheating on me! You are talking to women on the phone!" I went to bed to try and avoid [Ms Carrera] escalating. [Ms Carrera] entered our bedroom and began hitting, scratching and pinching me. She punched me in the head twice. I was also strangled, had my mouth with her hand covered and her nails subsequently dug into my cheeks and punched multiple times in the back. I jumped out of bed and grabbed my phone trying to move away from her into the spare bedroom, turning the light on as I entered. Before I had the chance to close the door [Ms Carrera] turned the lights off. I turned them on again. [Ms Carrera] turned them off again. I had activated my video recording by now. I believe [Ms Carrera] realised I was recording and so she started saying things like: "He's hitting me" and "He's hitting the baby as well. He's trying to kill me".
On that night I overheard [Ms Carrera] make a telephone call to who I now understand to me (sic) a 000 operator. I heard [Ms Carrera] request "Police". I heard [Ms Carrera] inform the operator "Hands, hands". I was scared of her, and glad she had called Police. [Ms Carrera] exited the bedroom and entered the spare bedroom, still talking to the operator. She closed the door behind her. Then [Ms Carrera] exited the spare bedroom and walked straight past me down the hallway and out of the apartment towards the lift. I do not recall her limping or showing any sign of discomfort.
I followed behind [Ms Carrera] for a few steps as she left the apartment. [Ms Carrera] entered the lift and I saw it travel to the ground floor. I saw [Ms Carrera] walking along the street. The Police arrived sometime later, and [Ms Carrera] and I were interviewed. I deny physically abusing [Ms Carrera]. If physical contact did occur, it was to protect/guard myself against her physical abuse. I am not aware of any photographs which support evidence [Ms Carrera] was bruised in her abdomen or anywhere else, arising from the abuse I am alleged to have carried out on [Ms Carrera] that night. I understand that [Ms Carrera]'s allegations eventually became that I kneed her in the stomach, which I would not do because I am protective of my knees ...
[Ms Carrera] assaulted me that night. It was frightening and I think I was left in shock. My instincts were to protect the baby and I said to police following the incident that I had plead with [Ms Carrera]: "Stop this, you will harm the baby!" I believe that [Ms Carrera] informed NSW Police I said to her - "Stop this, you will harm the baby!" which caused her to pause momentarily before she then kept hitting me. I do not know if this was (another) episode of hallucination or schizophrenia. I cannot explain her behaviour.
I note that I have previously undergone a [...] knee reconstruction procedure in 2015 and [another] knee reconstruction procedure in February 2021, and therefore using my knees as a weapon is something I would definitely avoid for fear of re-injuring the same. The [...] knee has two screws within the tibia and fibula, and required around 12 months of rehabilitation. Neither knee is reliable to date, and I would never have risked further injuring either knee which might have resulted in a regression in my mobility and stability...
Had I used my knee/s as a weapon I would have required and would have sought treatment of the same from my physiotherapist and medical practitioner.
... if somebody wrestles with you ... um, you know, you kind of have to put your knee to get in, knee in between to get the distance, um, to get, you know, to stop them coming towards you. But, yeah, um, and, like, because this time, espec [sic], today especially, like, I knew that this is what she's gunna try to do, um, try to get me to knee he (sic). So, um, like, I don't remember doing it. But it must've just been, like a rr (sic), you know, a reaction or reflex, like, when you get hit.
And when you say:
I started hitting her.
Do you accept the proposition that that is completely inconsistent with the version of you - events that you depose to in your affidavit filed in this court? Yes.
And the fact is that you were being truthful to this police officer in September 2021; isn't that right? Yes. Yes.
Right. And where that leads us is that what you've deposed to occurring on [...] September 2021 is incorrect; isn't that right? Yes. No. I've said I - I didn't her, yes, apart from hitting her hands away. Yes, that's - might not have been consistent with that. Yes.
(1) On 19 June 2021, as set out above;
(2) On 15 August 2021, in circumstances where the record made by Dr CC on the following day includes Ms Carrera advising that Mr Ragni " threw her phone";
(3) In September 2021, when the police record includes "[a]t one stage, the Victim also begins filming the Accused and he is seen to approach and physically grab her phone from her hands and push her, saying, 'I'm going to smash your phone.'"
Mr Ragni's conduct in taking Ms Carrera's phone without her agreement stopped her from using her phone, including to contact family members. That conduct was family violence.
The expert evidence relevant to family violence
If family violence occurred as alleged by the father, then it would be suggestive that the mother, at that time, had difficulties with impulse control, emotional regulation and coping with stress, without resorting to self-injurious behaviour and highly manipulative and attention seeking acts. The father's descriptions of the mother's behaviour are consistent with an individual with a personality disorder and/or a person with impulse control disorder.
If family violence occurred as alleged by the mother, then it would indicate that the father has difficulties with impulse control and emotional regulation and is prone to lashing out, verbally and physically. If this account is accurate, it would also suggest that the father is not prepared to accept responsibility for his behaviour and has continued to manipulate and control the mother via reputational damage and threat.
I consider it possible that both parents may have engaged in family violence during their marriage and/or that they were both immature with very poor skills in conflict resolution, noting that there were multiple compound stressors for both parents in the short period of their marriage; namely the covid pandemic and lockdown, an early pregnancy, health challenges [a suspected ectopic pregnancy and later diagnosis of an ovarian cyst/s and hyperemesis], and the involvement and possible interference of multiple extended family members.
It is almost impossible for me to determine whether family violence occurred as alleged and, if it did, whether it involved both parents or not. It is also difficult for me to ascertain the effect of family violence, if it occurred, on [X]. There is emerging evidence that infants in utero who are exposed to maternal stress, including family violence, have later vulnerabilities with their own psychological self-regulation and coping skills.
Other matters relevant to findings about family violence
[Mr Ragni] was critical of my friends and family and made it difficult for me to talk to my friends or family. Slowly I was feeling more isolated. For example [Mr Ragni] said to me on multiple occasions following conversations I had with my friend [Ms DD] words to the effect of: "I don't like [Ms DD]" "You want to be just like her" "She is a single mother" "She will try and convince you to break up with me". On 21 June 2021 [Mr Ragni] messaged me and asked me why I was talking to [Ms DD]. I assumed that he had heard my phone ringing and checked to see who it was. It concerned me that [Mr Ragni] was trying to prevent me from talking to my friends. On another occasion when [Mr Ragni] had discovered on my phone a text message from my cousin [Ms EE], [Mr Ragni] said to me words to the effect of "You don't need to speak to her. She was very rude to me".
So there was a altercation prior to that. In that moment, and that's - [Ms DD] was calling at that time. So, yes, then I was referring to - oh, yeah. I just felt like - you know, like, just felt like, yes, like somebody is - you know. When you're getting hit, you know, you become, yes, I guess suspicious that other people, you know, are, like encouraging it. So that's why. That was my mind state at the time.
Mr Ragni had not previously deposed to any physical altercation on this occasion. His evidence was incoherent. I find that he made up the evidence about being hit by Ms Carrera on this occasion under the pressure of cross-examination, and to try to justify his message about Ms DD.
Say, the other time where I asked, like, "Hey where are you going?" or "You need to tell me." Yes. Like, maybe, when she got back, just - could have just, you know, check in if she's okay, she's feeling okay, because 'I thought you were you know, not feeling well', kind of thing, because it's - yes. It's the way it's said a lot of the time, and yes...
You know, like, yes she's a grown adult. She's entitled to go outside ... Perhaps, I don't - it's - it's a tricky one because it's like where do you just not - if you have a partner, when do you stop caring or - like, a fine line between not caring versus being controlling, yes. Yes.
HER HONOUR: What did you mean when you - well, you're recorded as having said to police she makes threats against harming the baby. What did you mean by that? So I think I was linking it to, like, for example, on the 20th or when the big incident - incident happened on September - [...] September, how
'[...]? [...] September.
In 2021? 2021. Yes. That led to the separation
Sorry? the - the kneeing allegation. But, like, for example, during that time, she was saying, you know, "You're harming - like, [Mr Ragni] is harming the baby, [Mr Ragni] is harming the baby", when I wasn't, and she was doing the violence when I was. So basically, there was a lot of allegations back and forth. So if I said to her - and I did say to her that, "Stop this, you will harm the baby", you know, it was said right back to me. So that's how my concerns about harming the baby come about, because in - in - in times of, you know - in that state, there's no consideration for the safety of the baby, so -
You're saying she makes threats - she makes threats, now in 2022 presumably? Yes.
against harming the baby? Yes. I didn't mean it in that way. I said - I meant it in - there has been threats, like, not - well, that's my way of putting it.

Social history updated
This was a record made before Ms Carrera knew she was pregnant. The most plausible explanation for the record is that what Ms Carrera is noted as having said did in fact happen. Ms Carrera followed up with Dr AA on 9 July 2021 and it is recorded that she is "[r]ecognising husband's behaviours as DV." The notes continued: "[p]lan for family to come pick her up tomorrow - will go stay with them for a while in family home in Suburb G." Under cross-examination by the ICL, Mr Ragni attempted to explain what Ms Carrera had told Dr AA on the basis that Ms Carrera had been violent towards him. I find that Mr Ragni's evidence in this regard was not truthful and was an attempt to deflect responsibility from himself.
[Ms Carrera] will not offer any support for varying the current Police AVO before the Court until there is clear evidence of:
1. [Mr Ragni] completing an appropriate domestic violence course; and
2. Medical evidence (psychology intervention) for his anger issues.
(1) Mr Ragni's failure to give Ms Carrera her own key to their home for what I find was some months;
(2) Mr Ragni telling Ms Carrera not to lock the bathroom door;
(3) Mr Ragni sending a message to Ms Carrera's mother suggesting that Ms Carrera was endangering her pregnancy and complaining to his mother than Ms Carrera had not cleaned up vomit from a toilet seat;
(4) Mr Ragni telling Ms Carrera to wear a jumper rather than leave on a heater and complaining about her wasting his money because she wouldn't eat food in circumstances where she was suffering from hyperemesis gravidarum;
(5) Mr Ragni questioning Ms Carrera about talking with a friend of hers.
that's a well-established pattern of behaviour in coercive and controlling relationships where an act of violence occurs, there's some kind of separation or consequence sometimes. Other people are made aware of that, whether that's family members or the police. The perpetrator then expresses remorse, often really strong overtures of love, promises to change, and the victim-survivor accepts those, and there's a sort of honeymoon period, if you like, and therefore, the relationship is reconciled.
(1) Mr Ragni used family violence including physical violence and conduct which, taken together, constituted a course of controlling and coercive behaviour towards Ms Carrera during their relationship; and
(2) Mr Ragni has responded to Ms Carrera's evidence about family violence by trying to blame her and raise questions about her mental health and behaviour which are not justified; and
(3) Mr Ragni lacks insight into his behaviour and the impacts of his behaviour on Ms Carrera; and
(4) Mr Ragni's behaviour has contributed to Ms Carrera's high levels of anxiety - particularly around parenting arrangements for X.
General considerations
(2) ... the court must consider the following matters:
(a) what arrangements would promote the safety (including safety from being subjected to, or exposed to, family violence, abuse, neglect, or other harm) of:
(i) the child; and
(ii) each person who has care of the child (whether or not a person has parental responsibility for the child);
(b) any views expressed by the child;
(c) the developmental, psychological, emotional and cultural needs of the child;
(d) the capacity of each person who has or is proposed to have parental responsibility for the child to provide for the child's developmental, psychological, emotional and cultural needs;
(e) the benefit to the child of being able to have a relationship with the child's parents, and other people who are significant to the child, where it is safe to do so;
(f) anything else that is relevant to the particular circumstances of the child.
(2A) In considering the matters set out in paragraph (2)(a), the court must include consideration of:
(a) any history of family violence, abuse or neglect involving the child or a person caring for the child (whether or not the person had parental responsibility for the child); and
(b) any family violence order that applies or has applied to the child or a member of the child's family.
I am also required to apply s 60CG of the Act which provides:
(1) In considering what order to make, the court must, to the extent that it is possible to do so consistently with the child's best interests being the paramount consideration, ensure that the order:
(a) is consistent with any family violence order; and
(b) does not expose a person to an unacceptable risk of family violence.
(2) For the purposes of paragraph (1)(b), the court may include in the order any safeguards that it considers necessary for the safety of those affected by the order.
EVIDENCE AND FINDINGS IN RELATION TO S 60CC FACTORS
Separately, I think that each of the parents are loving, tender, caring, and very positive with [X]. I think they are highly intelligent, capable and successful individuals who have much to offer their daughter. I do not have any concerns about either parent's parenting capacity.
That the parties agree that upon birth of the baby, our client is able to attend the hospital and spend time with the baby each day for a period of no less than 2 hours per day, where for such periods your client will ensure that the father's time is uninterrupted by the mother (unless her assistance is sought by the father or hospital staff) and/or her family members and friends, and excepting hospital staff;
That upon your client's return to her home ... she will provide our client with uninterrupted time with the baby for no less than 2 hours during each day, preferably during a time the mother expects the baby to be awake, until further order or agreement.
To the extent that any expert evidence is needed to conclude that these requests were completely inappropriate, Dr C agreed with the following propositions put to her by senior counsel for Ms Carrera:
these are quite assertive requests being made by the father
even outside of the context of these parties' relationship, that this could be interpreted by an expectant mother in a fairly negative fashion?
within this context of this relationship - that is, if her Honour accepts that this is a relationship marked by family violence, where the father was the main perpetrator, that this is likely to have been interpreted by [Ms Carrera] in a frightening and controlling way.
[i]t is more difficult for me to accurately assess the father's capacity to provide for [X]'s needs, including her emotional and intellectual needs, given he has in aggregate spent very limited time with her. On observation, and consistent with the reports from the [K Contact Service], the father has learnt many skills in caring for his young daughter, including being able to soothe her, respond to her cues, play in a developmentally appropriate way and avoid over stimulating her. He is also beginning to learn skills in childcare, such as appropriate feeding and nappy changing routines. The father has demonstrated a very good capacity to follow advice, learn skills and develop these capacities, which is to his credit...
The father has also had limited opportunities to care for [X] independently and has not yet learnt the requisite skills to manage her emotions and behaviour over the longer term, including establishing appropriate routines for [X], managing her different mood states and energy fluctuations, caring for her when she is ill, supervising her in a range of environments and facilitating physical play, social development, sleep and feeding routines ... I think that the father either has the capacity to develop these skills and/or would follow appropriate advice from professionals or family members to develop these skills, it is just that at this stage they are as yet untested.
[w]hilst she continues to make a good recovery, due to the nature of her condition I still feel she needs close supervision and to be kept in a calm, stress free environment to prevent any complications and risk of infections. She is due to see the specialist in the new year and she can aim for a return to the contact centre from January 2023.
His actions disclosed below are facilitating and enabling potential child abuse via parental alienation and psychological harm of my daughter [X]. He does this by providing false medical certification...
The lack of medical reasoning and unsubstantiated medical [sic] speaks for itself. It's clear it was [Dr D]'s [sic] intention to facilitate child abuse through alienation of me as a parent.
Mr Ragni gave evidence that that remains his view. It is an extreme and unreasonable view to hold, and leads me to find that Mr Ragni may approach the resolution of issues that may arise between him and Ms Carrera in a way which escalates conflict and difficulties, and which expands such conflict to include professionals involved in X's life.
[RAGNI] wanted the Victim charged with perjury and false accusation offences - police explained that the matter was tried fairly in court and the offences he is suggesting are not applicable in this situation. Police had prima facie to charge [RAGNI] and apply for AVO. At the time of the initial investigation, police spoke to [RAGNI] about the Victim assaulting him. This allegation was investigated and it was deemed that both parties were physical with each other, however the video indicates that [RAGNI] was the instigator, and the Victim was acting in self defence. This is why the Victim was not also charged on the day. The matter has been fairly tried in court and police explained to [RAGNI] that no further charges relating to this incident will be laid.
And did the police then tell you they were looking at charging the mother? They - they asked those kinds of questions. Like, "Do you want us to charge her? Do you want us to" - like, you know, "Why are you here?" But - yes. I didn't, like - I didn't - yes. Like, we didn't have - we didn't go into that. It was just, "Come back with your information." But - yes. The main purpose was to make a statement and - yes. And then they obviously say, like, "We can look at a charging her if there is" - yes. But I wanted them to - yes.
HER HONOUR: You wanted them to what? Sorry. If you don't finish your answer, I don't know what your answer is? Sure. Sure. Sorry. Yes. I wanted them to consider - like, consider, you know, if there is - like, what action - not necessarily charge, but, like, a warning, perhaps. Yes. Or have a speak - chat to her.
MS CLIFTON: It actually says, [in] February 2023, on page 1346:
[Ragni] wanted the victim charged with perjury and false accusation offences.
So you did want her charged, didn't you? Not necessarily, no. I don't - yes.
Why did you tell the police that then?
HER HONOUR: Or did you tell the police that?
MS CLIFTON: Well, it's written here. Quite - so quite right. That's what it says. It says:
[Ragni] wanted the victim charged with perjury and false accusation offences.
Did you say that to the police? Like, I'm not - I wanted it to be -
HER HONOUR: "Did you say that to police?" is the question? No.
MS CLIFTON: No. No. You're saying it was incorrectly recorded? Yes. I wanted it reviewed. Like, them to review it. Yes.
Okay. So the police made a mistake, do you think, then? Yes. Or they're writing it in their context because - but - yes. I definitely wanted it, yes, reviewed. Not necessarily go back to court and have a trial on it and all of that, but - yes. You know, it's - yes. Definitely. Like, if there is action to be taken, then, yes, to do - you know, whatever. If they think it's appropriate to have a chat with her, then, yes, that's fine. If they think that, you know, she committed an offence, then we can, yes - like, obviously, then I will get legal advice. But - yes.
We confirm that our client undertakes not to provide your client's address to any third party and note our letter of 9 July 2024 clearly indicated that our client will not disclose your client's address to third parties.
quite understand ... the reasoning for why ... she would be upset if she didn't know where she lives - or she's there in the exact period of time. So we've communicated - or she should be aware that ... it's there - any of those communications ... so the supervisors knows where she is and ... so she shouldn't - like, think to turn up, that's not - yes, but it would - I - I understand the reasoning, yes...
(1) While Ms Carrera gave evidence that she was able to communicate with Mr Ragni about X by email, it is a different thing to say that she is able to participate in a process of decision-making with him, given what I accept is her considerable anxiety and fear associated with dealing with Mr Ragni - in part at least because of his use of family violence against her. It is in X's best interests to minimise such anxiety and fear on the part of Ms Carrera.
(2) There is absolutely no trust between the parents. Both are highly suspicious of the other. As an example, both parents said that X had used the term "monster" towards them and both attributed it to something that the other parent had said to X about them. Dr C agreed with the proposition that the parents' attitudes towards X's comments about "monsters" "demonstrates really quite a significant distrust between one and the other."
(3) There is no history of co-parenting and no reason to be confident that the parties will be able to engage in co-parenting. The parents have not yet communicated directly and have been using lawyers or the changeover service to communicate between them. Dr C agreed with the proposition that "the likelihood of distrust abating in a quick fashion is a bit limited."
(4) Mr Ragni has behaved in ways of which I am critical in relation to X's medical treating professionals and enrolment in daycare.
(5) Given the history of his behaviour, I am not confident that Mr Ragni would communicate with Ms Carrera in a respectful and appropriate way.
(6) Ms Carrera can be trusted to make appropriate decisions for X.
(7) There are a number of major long-term decisions which will soon need to be made for X, including which year she will start school (whether in 2027 or 2028), and where she will go to school.
(8) It was Dr C's recommendation in relation to parental responsibility and decision-making that one parent have parental responsibility for X but be required to seek and consider the views of the other parent. She confirmed under cross-examination that remained her recommendation.
(9) Ms Carrera gave evidence that she does not intend to change X's name, and I am satisfied that she will not do that.
if the mother is - has experienced family violence from the father, and particularly with elements of coercive control, then her tolerance for - and capacity to exhibit parenting behaviours that help [X] cope with living in two households, would be very limited. And so what that would mean, on a practical level, is the longer she spends away from her mother, the more anxious the mother would become, the more likely the mother would scrutinise [X]'s behaviour, body, mannerisms, utterances when she returned to the father, through the lens of, "He is a dangerous man, and he might have either hurt her directly, or sought to manipulate her psychologically to undermine me as a mother", for example. So she would be unlikely to help [X] have the sort of adaptive and positive skills to cope with different things in dad's house. So I would say that it would - if the court finds the mother has been a victim of family violence, and particularly coercive control, the mother would - would not have a - a well-developed set of capacities to help this very young child cope with a - a sort of effectively shared care arrangement. And so that would be the first response to it. The second would be that if - if that is the case, and the court has found family violence occurred with the father as the perpetrator, then it's quite - quite substantial literature that often, patterns of coercive control are played out in parenting dynamics, with children being effectively used to sort of - the perpetrator undermining the parental authority of the victim parent, by subtly or overtly undermining their parental authority to the child. "You don't have to do what Mummy says. She is too strict. There are no iPad rules here". That kind of thing. And therefore undermining her confidence, and confusing [X] about how trustworthy her mother is ... there would be things in the parenting behaviours which would make living between two households, accepting and trusting my parents love me and want the best for me, would make those things very challenging for a young child.
... a more conservative approach could ameliorate some of those problems, but in and of itself, it's not going to resolve anything other than [X]'s own developmental improvements, if you like, in that time. Time alone doesn't improve parental trust. In fact, sometimes it can do the opposite. Time alone won't necessarily improve the mother's capacity to exhibit problem-solving parenting skills for [X]. And, you know it's not going to - time alone won't improve communication. What time will do is improve [X]'s own communication skills, her cognitive capacity, and hopefully her emotional tolerance for some emotional distress.
So, yes, there could be benefits in delaying the over - overnight start, for reasons that I gave evidence on earlier ... By the time she's nearly five, she is going to be well aware that there's - I'm assuming that the cousins are going to be staying at - at grandma's house, and there are going to be exciting things that happen after 5 pm that she might want to be part of. And she will, at that age, start to feel different and wonder why she is not allowed to be part of - I'm just thinking of the merriment of that house ... the normal pattern that children in that household are exposed to. And I think that might be challenging for her to understand.
