Mr David Song, town planner, SongBowden Planning Pty Ltd
Application under section 79 of the Planning and Environment Act 1987 to review the failure to grant a permit within the prescribed time[1]
The land adjoins a road in a Road Zone Category 1 (RDZ1) (High Street Road)
Clause 32.08-6 (construction of two or more dwellings on a lot in GRZ)
Clause 52.06 (reduction in parking requirements for dwelling visitors)
Clause 52.29 (alteration to access to a road in a RDZ1)
Clauses 9, 10, 11, 15, 16, 18, 21.05, 21.07, 22.07, 32.08, 52.06, 55 & 65
The land is on the south side of High Street Road, about 14 metres west of Catalina Avenue and about 150 metres west of Warrigal Road. The land comprises two lots. It has a combined frontage of 36.6 metres, a depth of 39.6 metres and an area of 1,449 square metres. The land falls about one metre from the north to south boundary and from the east to the west boundary. The land comprises two lots, each of which is currently developed with a single-storey dwelling with a pitched tiled roof.
On 9 June 2017, the Tribunal inspected the subject land, 17 Liberator Street, and the neighbourhood, unaccompanied by the parties
In accordance with section 69 of the Planning and Environment Act 1987, an application may be submitted to the responsible authority for an extension of the periods referred to in this condition
[1] Section 4(2)(d) of the Victorian Civil and Administrative Tribunal Act 1998 states a failure to make a decision is deemed to be a decision to refuse to make the decision.
[2] The submissions and evidence of the parties, any supporting exhibits given at the hearing and the statements of grounds filed have all been considered in the determination of the proceeding. In accordance with the practice of the Tribunal, not all of this material will be cited or referred to in these reasons.
[3] The plans refer to the level of the townhouses above the basement as the 'ground floor', the floor above as level 1, and the topmost floor as level 2. I therefore refer to the levels of the townhouses as ground floor, level 1 and level 2, rather than by reference to storeys or floors.

[6] Boroondara City Council, Precinct Statement, Character Precinct 67, October 2013, p 5.
[7] As I discern that the ground floor area and width of townhouse 3 is the same as those for townhouses 4 & 5, I have assumed that the secluded private open space for townhouse 3 is the same as that for townhouses 4 & 5 ie 14 square metres. Hence, I calculate the width of each of the townhouses as 4.3 metres. I make that calculation because the width is not dimensioned on the plans.
