- The applicant gave evidence in which he denied all the allegations made by the complainant in relation to sexual contact between them. He said that he took four girls for driving lessons and that he was never on his own with the complainant. He said that he never took the complainant out on her own because she was too young to be driving and his wife would "go crook". He said he started to teach her how to drive when she was 16 or 17 years old, not 14 or 15, and that she and her sister were always in the car together. The applicant admitted that he had had a vasectomy many years ago. Evidence was also given during the defence case by three other young women who visited the farm and kept horses there.
- As well as denying the allegations, the applicant said that he and the complainant were never alone at the property and were only alone in his car if they were on their way to pick up the other girls. He said sometimes he was alone with one or other of these girls, but never alone with the complainant. In the defence case further evidence was given by a man who also kept a horse on the property.
