On 21st November 1973 the Australian Bank Officials' Association, "the Association", an organization of employees registered pursuant to the provisions of the Conciliation and Arbitration Act 1904 (as amended), "the Act", filed with the Industrial Registrar of the Australian Conciliation and Arbitration Commission two applications pursuant to the provisions in s. 139 (1) of the Act. The first of the said applications was an application for the consent of the Industrial Registrar to an alteration made to the rules of the Association insofar as they related to conditions of eligibility for membership of the Association. The second of the said applications was an application for the consent of the Industrial Registrar to an alteration made to the rules insofar as they related to the description of the industry in connexion with which the Association is registered pursuant to the provisions of the Act.
