- The applicant, who is now aged 31, was committed for trial in the County Court at Melbourne on 28 November 1997 on 13 charges. Two co-accused, Angela Hronis and Rocco Iulanella, had each been committed on the same charges on 27 August 1997. On 15 June 1998 a presentment was filed in the County Court alleging against the applicant the following offences:
- On 15 June the applicant was arraigned on counts 5, 6, 7 and 8 and pleaded not guilty to counts 5 and 7 and guilty to counts 6 and 8. The prosecutor announced that the Crown would not lead any evidence on counts 5 and 7 and a verdict of not guilty was entered by direction on these counts. On 16 June the applicant was arraigned and pleaded not guilty to counts 1, 2, 3 and 4. On 17 June the trial commenced and proceeded until 22 June, when the jury returned a verdict of not guilty on counts 1, 2 and 3 and guilty on count 4.
