1 This application for leave to appeal came on for hearing before us on 17 March 2009. At the commencement of the hearing, Mr Trapnell of Senior Counsel who appeared for the respondent, conceded that the Court could not be satisfied upon the whole of the evidence that it was open to the jury to be satisfied beyond reasonable doubt that the appellant was guilty of the Giretti trafficking count charge in count 1. This concession was made properly.
