Criminal law - Appeal against sentence for sexual offences committed on applicant's daughter - Error in cumulation directions conceded by the Crown. Appeal allowed and applicant re-sentenced.
- The applicant, who is aged 55, pleaded guilty in the County Court at Melbourne on 11 September last to a presentment containing six counts of indecent assault (counts 1 to 6 inclusive), two counts of incest (counts 7 and 8) and one count of the commission of an indecent act with a child under 16 (count 9). These offences, which occurred at Woori Yallock and Frankston between 11 June 1986 and 10 June 1992, carried maximum penalties of 5 years, 20 years and 10 years' imprisonment respectively.
