- There are two appeals (Nos. 4030 and 4031 of 1998). Judgment was delivered in both on 22 December 1998. Each appeal was dismissed and the question of costs was reserved. Subsequently, in accordance with directions given, the parties filed submissions about costs; there was also filed on behalf of the third respondent, an affidavit of P J Dillon over 100 pages in length, most, if not all of the material in which was plainly unnecessary. We cannot imagine what prompted the filing of this remarkably prolix document. It is also noted that the orders entered in the two appeals on 18 January 1999 require correction.
