- The applicant is now 41 years of age. The children against whom the offences were committed were the children of the first marriage of the applicant, a marriage which ended in the early 1980's. The applicant married RM in 1985 and they had two more children. RM, who is some four years older than the applicant, had been unemployed since 1980 and had derived an income from a disability pension. The couple lived in a house at Werribee with all the applicant's children when the offences for which the applicant was sentenced occurred.
- The offence of gross indecency occurred when the victim was aged 13 or 14 years. She was in bed in a room opposite her parents' bedroom. The doors of the rooms were open. The daughter gave this evidence at the trial:
