REASONS FOR JUDGMENT - McPHERSON AND PINCUS JJ.A.
On 30 October 1992 the three applicants Cornale, Nicholson and P now before this Court pleaded guilty in the District Court at Brisbane to a series of offences of unlawfully using motor vehicles and stealing committed during 1991 and 1992. On that day they came before Judge Kimmins and were sentenced to terms of imprisonment of four years on each count to be served concurrently, but with a recommendation for release on parole after serving 12 months.
The three applicants were members of a group or gang of five or more youths or young men, of whom another two were Scott Dent and Michael Hoffmann. They were indicted jointly with the applicants and were also due to be sentenced before Judge Kimmins on 30 October 1992. On that occasion, however, counsel for Dent and Hoffmann succeeded in obtaining adjournments of the sentences hearing in their two cases.
