Pucek v Tirimacco & Anor [2025] SACAT 86
The applicant tenant sought compensation pursuant to s 110 of the Residential Tenancies Act 1995 (the Act) on the basis of the landlord's breaches of s 68 of the Act.
The tenant claimed compensation totalling $18,256 because of the impact of these breaches on his use of the property, the time taken for him to correspond with the agent and trades about remediation, and time taken to facilitate trades attendance for inspections, quotes and repairs.
The landlords gave evidence to the Tribunal, through their agent, about the steps they had taken to address the repairs issues raised by the tenant.
