"Equal Remuneration
7. The proposed new Award provides for equal remuneration and other conditions of employment for men and women under the Award who are performing work of equal or comparable value.
8. To the best of my knowledge, the proposed new Award provides:
a. equal rates of pay and allowances for men and women
b. the same eligibility criteria for employment for men and women for each job classification
c. the same duties for men and women under each job classification, and
d. conditions of employment which promote equal access to employment for men and women.
Public Interest
9. The making of the proposed new Award is in the public interest, having regard to the factors in ss 3 and 146(2) of the IR Act, as well as that the parties to the Award have negotiated and seek the proposed variations by consent.
Objects of the IR Act
10. The proposed new Award accords with the objects in s 3 of the IR Act, as, in my opinion, the increase in salaries and salary-related allowances provided and the other amendments to the Award:
a. will support the attraction and retention of staff to ensure the continued effective and efficient delivery of health services; and
b. will promote efficiency and productivity in the economy of the State of NSW by supporting the provision of ongoing quality health services to the community.
Economy of New South Wales and fiscal position and outlook of the Government
11. The proposed new Award covers a workforce of approximately 500 full-time equivalent employees (as at 29 April 2025).
12. It is, therefore, not expected that the making of the proposed new Award will have an adverse effect on the state of the economy of New South Wales or the fiscal position and outlook of the NSW Government as the Award covers a relatively small numbers of employees.
13. Further, to the best of my knowledge, information and belief, the terms of the proposed new Award were approved by the NSW Government after taking into account the NSW economy, the fiscal position and outlook of the Government and the likely effect of the creation of the proposed new Award on the NSW economy, fiscal position and outlook."
"The proposed new Award includes an updated no extra claims clause that is agreed between the parties. This clause, on its terms, does not prevent the parties from continuing collaborative discussions during the term of the proposed new Award to deliver additional enhancements to remuneration or conditions of employment, and to achieve additional industry wide and systemic efficiencies and productivity improvements to the delivery of Government services to the public. The clause also provides that changes to conditions or salaries may be jointly progressed and, if agreed, an application to vary the Award may be made by consent prior to the nominal expiry of the Award."
(1) the 2024 Award continuing the terms of the 2023 Award, save for the amendments identified which objectively improve the conditions of employment for employees;
(2) all parties consenting to the Award, notably after protracted negotiations; and
(3) the evidence of Ms Murphy that the Award provides equal remuneration and other conditions of employment for men and women.
(1) the application having been made by an employer;
(2) the parties to the Award being persons who are permitted to apply for the making of an award; and
(3) each of those parties having a sufficient interest in the 2024 Award because they have either members who will be covered by the Award, or is the employer of employees to be covered by the Award.
(1) the 2024 Award being in writing and expressed to be an award;
(2) that it will be signed by a member of the Commission in due course and published by the Industrial Registrar; and
(3) the 2024 Award otherwise apparently complying with the requirements as to form and procedure for its making, as set out in the regulations and rules of the Commission.
"4. No extra claims commitments
4.1 A consent application to make or vary an award may involve parties giving a no extra claims commitment in agreed terms. Such a commitment may take the form of an undertaking to the Commission not to pursue claims for extra or reduced terms and conditions that would take effect during the nominal term of the award, with or without identified exceptions.
4.2 Absent extraordinary circumstances, the Commission will not vary or make an award that is inconsistent with a no extra claims commitment unless otherwise expressly permitted by the award or by consent of the parties.
4.3 The Commission will not include in an award a clause that prohibits a party making an application under the Act or participating in proceedings under the Act."
"(i) The Industrial Relations Commission recognises that the parties have provided an undertaking that other than as provided for in the Industrial Relations Act 1996, there will be no further claims/demands or proceedings instituted before the NSW Industrial Relations Commission for extra or reduced wages, salaries, rates of pay, allowances or conditions of employment with respect to the Employees covered by this award that take effect prior to the nominal expiry of the award unilaterally made by a party to this award unless otherwise agreed by the parties.
(ii) This undertaking does not prevent the parties from continuing collaborative discussions during the term of this Award to deliver additional enhancements to remuneration or conditions of employment, and to achieve additional industry wide and systemic efficiencies and productivity improvements to the delivery of Government services to the public. Changes to conditions or salaries may be jointly progressed and, if agreed, an application to vary the Award may be made by consent prior to the nominal expiry of the Award.
(iii) The parties are not prevented from commencing any proceedings with respect to the interpretation, application or enforcement of existing award provisions."
