defendant. Orders made requiring respondents to remove current sign within 30 days; respondents may replace with either (a) sign of same design/style/materials/dimensions as previously approved, or (b) sign...
A body corporate can require an owner to remove signage from common property if the owner replaced an approved sign with a different one without getting fresh written approval. Approval for a sign only covers that specific sign in its approved form. If an owner wants to change the sign's design, materials, or dimensions, they must get new written approval from the committee. Informal conversations with individual committee members are not enough. The owner must either put back the original approved sign or apply for approval of a new design.
