1 The plaintiff is, and has for some years been, subject to an involuntary treatment order and thus an involuntary patient under the ("the Act"). As such he resides in a secure facility at the Royal Talbot Hospital conducted by Austin Health. This case arises out of his failed appeal to the Mental Health Review Board ("the Board") for the discharge of that order, and the affirmation of that decision by the Victorian Civil and Administrative Tribunal ("the Tribunal").
