1 Nenad Bakic (the plaintiff) has applied by originating motion for an order quashing the decision made on 30 April 2002 in the Magistrates Court at Ringwood adjourning an application for compensation under of the (Vic). The application had been brought against Yamasa Seafood Australia Pty Ltd Park (the first defendant). The plaintiff also seeks relief in the nature of mandamus requiring the learned magistrate to proceed to hear the compensation application.
