TRUSTEES - Joint trustees - Indemnification - Costs and expenses incurred by one trustee without agreement of co-trustee - Requirement of unanimity of trustees - whether costs recovery as benefits to the estate.
1 The plaintiff and the defendant are respectively the daughter and son of Frances Tack ("the deceased"), who died on 6 January 2006. The deceased left a will dated 14 January 2003, by which she appointed the plaintiff and the defendant as the executors of her estate, and by which she devised the whole of her estate to them in equal shares as tenants in common. Probate of the will of the deceased was granted to the plaintiff and the defendant by order of the Supreme Court on 15 May 2006. In these proceedings, which were commenced by originating motion, the plaintiff seeks reimbursement of expenses which she claims were incurred by her for and on behalf of the estate of the deceased.
