(#P52_5463) It should be noted that there are inconsistencies in the identity of the company that took over distribution for the Respondent. The Applicant refers to the company as "Wholesale Beverage Company T/A Kollaras" whereas the Respondent refers to it as "Tosti Cellars at Port Kembla Pty Ltd T/A Wholesale Beverage Company." As both parties refer to the company as "Kollaras" in their communications to each other, this is the term I have adopted for the purposes of this Decision.
