All applications and complaints made by the applicant are dismissed.
I am writing to inform you that by living in the garage at the above address, you are in breach of Section 40(10) of the Building Act 1993;
40 Occupation must be in accordance with permit
(1) A person must not occupy a building in contravention of the current occupancy permit or permits issued under this Division for the building.
Penalty: 120 penalty units, in the case of a natural person.
600 penalty units, in the case of a body corporate.
The reason for this is that a garage is a non habitable building.
The garage is not fit for human occupation as the floor is not properly sealed to prevent rising damp, the wall and ceiling of the garage is not insulated, the ceiling height may not be a minimum of 2.4m the garage is not provided with openable window for natural light and ventilation and there are no smoke detector within the garage.
All these issues affect the health, amenity and safety of a person occupying this space.
As per the current building order, you must immediately cease the occupation of the garage and vacate the garage.
If you continue to occupy the garage, a charge and summon will be served to you for illegal occupation of the garage and a court proceeding will commence at the Magistrates Court.
Should you require further clarification on the above matter, please contact Peter Truong on 9238 1486.
