DECISION
- This is an application by Petrus Paulus Hendrikus Johannes Janssen ("Mr Janssen") for relief from victimisation by South Western Sydney Local Health District ("SWSLHD"), under section 213 of the Industrial Relations Act 1996 ("the Act") ("the Victimisation Application").
- SWSLHD submits that aspects of the Victimisation Application have been filed out of time and objects to the Commission granting any extension of time. The objection has been heard and determined as a preliminary matter.
- Mr Janssen was represented by Mr Latham and SWSLHD by Mr Britt, both of Counsel. The evidence filed in support of the extension of time was an Affidavit of David Taylor, solicitor for Mr Janssen, dated 2 November 2017. In addition to oral submissions at the hearing on 24 November 2017, both parties filed written Outlines of Submissions and Mr Janssen filed an Outline of Submissions in Reply. I have had regard to the evidence and submissions in making my decision.
