1 Perpetual Ltd alleged that Ms Buttarelli had applied for a loan of $310,000 by an application dated 19 January 2003 (the Loan Application). The Loan Application was prepared and submitted by St James Finance Corporation Pty Ltd (St James). The application stated that the purpose of the proposed advance was to purchase a property located at 33 Tyrall Avenue, Port Kennedy (the Port Kennedy Property) for an amount of $145,000 and to refinance other borrowings in an amount of $122,500 (affidavit of Evashini Chetty sworn 22 July 2010, pars 8.1 and 8.2 and attachment 'EC5'; Ms Chetty was a manager of Perpetual when she made her affidavit).
2 Perpetual claimed that it had granted the Loan Application and that a loan contract had been subsequently made with Ms Buttarelli on or about 27 February 2003 (the Loan Contract). The Loan Contract provided for an advance of two amounts of $155,000 each (designated by Perpetual as loan account numbers 60126261 and 81721951). Ms Chetty stated that those amounts were drawn down and disbursed under the Loan Contract on 27 February 2003 (Ms Chetty's affidavit, pars 8.3 8.5, 9 and 10 and attachment 'EC6'). The advances were alleged to have been secured by first registered mortgages granted by Ms Buttarelli over the Port Kennedy Property and land located at 74 Drummond Street, Bedford (the Bedford Property; the mortgage in respect of the Bedford Property is referred to in the reasons as 'the Perpetual Mortgage') (Ms Chetty's affidavit pars 7 and 16 and attachments 'EC1' 'EC4').
