High Court of Australia Dixon, Williams, Webb, Fullagar and Kitto JJ. Partridge v Chick [1951] HCA 67
ORDER Appeal allowed with costs. Discharge so much of the order of the Supreme Court as dismisses the two summonses dated respectively 14th December 1950 and 13th June 1951 and orders that judgment be entered for the defendant with costs. In lieu thereof substitute an order that the point of law arising upon pars. 7 and 10 of the defence in relation to the allegations contained in the statement of claim be determined by a declaration that the death of Leslie Frederick Chick before the death of George Frederick Partridge affords the defendant as administrator of the estate of Leslie Frederick Chick no answer to the plaintiff's claim in the action under Part III. of the Wrongs Act 1928 as amended. Further order that the plaintiff's costs of the said summonses and of the proceedings thereon be taxed and paid by the defendant to the plaintiff. Certify that so far as such proceedings were in chambers they were proper for the attendance of counsel.
