RETAIL TENANCY DISPUTE - whether the Tribunal should extend the time by which a tenant must satisfy the conditions upon which relief from forfeiture was granted - whether the tenant had a reasonable excuse for not satisfying the conditions upon which relief from forfeiture was granted - whether the prejudice suffered by the landlord in granting an extension of time outweighs the prejudice suffered by the tenant in not granting an extension of time - jurisdictional basis to extend the time for compliance with orders made by the Tribunal - whether a delay in making an application for an extension of time is detrimental to the granting of an order to extend time - whether analogous to an application for relief against forfeiture.

Paramount Investments Group Pty Ltd v Club Fogolar Furlan Melbourne (No 3) (Building and Property) [2024] VCAT 666
Mr N Andreou of counsel with Mr J O'Halloran of counsel
(a) an order in the form of an interlocutory injunction restraining the Landlord from re-entering or taking possession of the Premises; or alternatively,
(b) an order that it be relieved from forfeiture of the Lease.
(a) By 12 January 2024 or such further time as may be agreed between the parties, the respondent must pay the applicant 65% of the rent in arrears, as set out in the notice of breach of lease dated 5 September 2023 ($168,244.48).
(b) From 2 July 2023 until 14 December 2023, the respondent must pay the applicant 80 percent of all rent and outgoings due and payable under the Lease.
(a) whether a party seeking the extension can show an acceptable explanation for the delay;
(b) whether it is fair and equitable in the circumstances to extend time;
(c) the actions of the party applying for the extension;
(d) whether the delay may result in the unsettling of other people or of established practices;
(e) the merits of the substantial application; and
(f) considerations of fairness between the applicant and other persons in a like position.
In cases of applications for relief from forfeiture for non-payment of rent, equity by analogy applies the six-month limit that s 79 of the Supreme Court Act 1986 (Vic) imposes in a case where the lessor has preceded by action to execution and will refuse relief to the tenant where more than six months has elapsed from re-entry.[7]
