Original judgment source is linked above.
(1) Mr Panayioutou had not pointed to any written law applicable to his circumstances that would mean that the provisions of the Fees Regulations did not apply to him.
(2) The proposed appeal notice did not fall within any of the exemptions provided for in the Fees Regulations.
(3) A fee was accordingly payable by Mr Panayioutou upon filing the proposed appeal notice.
(4) The registrar had reduced the fee applicable to the fee payable by an 'eligible individual' on the basis of financial hardship.
(1) The Governor may make regulations providing for or prescribing the fees to be paid -
(a) when commencing a cause or matter; and
(b) when entering a cause or matter for trial or at any other stage of proceedings in a cause or matter; and
(c) when lodging a document with the Court or depositing a will or instrument under section 44 of the Wills Act 1970; and
(d) for the issue of any document by the Court; and
(e) for the service of any document; and
(f) in respect of the conduct of the business of any office of or connected with the Court; and
(g) for the carrying out of any order or warrant of the Court.
8A. Recognition as eligible individual or eligible entity
(1) On an application under regulation 8(1)(a) the Court or a registrar may direct that a person is an eligible individual described in regulation 7(2)(f) if satisfied that the person should be required to pay only an eligible individual fee in respect of the matter for either, or both, of the following reasons -
(a) financial hardship;
(b) the interests of justice.
(2) On an application under regulation 8(1)(b) the Court or a registrar may direct that a person is an eligible entity described in regulation 7(3)(b) if satisfied that the person should be required to pay only an eligible entity fee in respect of the matter for either, or both, of the following reasons -
(a) financial hardship;
(b) the interests of justice.
(1) A person may apply for -
(a) a direction under regulation 8A(1) that, in respect of a matter specified in Schedule 1, the person is an eligible individual described in regulation 7(2)(f); or
(b) a direction under regulation 8A(2) that, in respect of a matter specified in Schedule 1, the person is an eligible entity described in regulation 7(3)(b).
(2) An application is to be in the form of Schedule 4 Form 2 and is to specify -
(a) for an individual - the matter in respect of which the individual is seeking to pay the eligible individual fee; or
(b) for an entity - the matter in respect of which the entity is seeking to pay the eligible entity fee.
(3) Despite anything else in these regulations, a fee is not to be charged in respect of an application under subregulation (1).
(a) the fee payable by an individual who is not an eligible individual is the fee shown in column A for that item; or
(b) the fee payable by an eligible individual is the eligible individual fee for that item; or
(c) the fee payable by an entity that is not an eligible entity is the fee shown in column B for that item; or
(d) the fee payable by an eligible entity is the eligible entity fee for that item.
(1) The policy underpinning the Fee Regulations is that the fee (if any) specified in sch 1 must be paid save in circumstances where the regulations provide otherwise.
(2) The only power which the court or a registrar has to reduce the fee (if any) payable by an individual is by directing that the individual is an 'eligible individual' as described in reg 7(2)(f), thereby allowing them to pay the relevant reduced fee (if any) specified in column C of sch 1.
(1) Other provisions in the Fees Regulations including reg 6(2) which expressly permits the court or a registrar to direct that the payment of the whole or part of a fee or fees in respect of a claim for personal injuries be deferred.
(2) The fact that the word 'waive' only appears once in the Fee Regulations, namely in reg 8D, which in turn permits the court or a registrar to waive a fee payable with respect to the obtaining of the transcript or copies of certain documents, if satisfied that doing so 'would assist in the efficient operation of the Court'.
(a) reg 7 of the Fees Regulations was amended so as to read substantially in its current form; and
(b) the notions of 'eligible individual' and 'eligible entity' were introduced.
I certify that the preceding paragraph(s) comprise the reasons for decision of the Supreme Court of Western Australia.
