PALD Medical Specialists Group Pty Ltd v Revenue SA [2025] SACAT 87
The applicant sought review of a decision of the Treasurer's delegate to attribute a commercial use to the applicant's land for the purposes of s 8(2) of the Emergency Services Funding Act 1998 (the Act).
The applicant sought for the decision under review to be set aside and substituted with a determination that the land use of the property is 'other', in accordance with the definition under s 8(1)(e) of the Act. The applicant submitted that the Valuer-General, and the Minister's delegate, makes inconsistent decisions under s 8 of the Act in relation to medical facilities and relied on unclear concepts in its decision-making. The applicant argued that the Commonwealth declaration of the combined facility operating partially on the land as a 'hospital', and the State licensing of the facility as a 'day procedure centre', should be determinative.
The respondent submitted that the decision under review should be affirmed as correct and preferable. The respondent argued that the Tribunal should place significant weight on the highly specialised expertise of the Valuer-General's assessors in making determinations about land use under s 8.

[2] Difficulty to re-purpose and related concepts are only relevant insofar as they may relate to the 'purpose built' nature of a property for undertaking the predominant functions on the particular day - but again it is only the actual activity and use that matters.
[3] I note that the Property and the Irrelevant Property are separate properties that appear to be owned by separate entities.
