NICHOLAS NI KOK CHIN [2026] WASC 40 (20 February 2026)

1. By originating motion filed 27 January 2026, the applicant, Nicholas Ni Kok Chin, seeks leave pursuant to Vexatious Proceedings Restriction Act 2002 (WA) (VPRA) s 6(1) to commence proceedings. Leave is required as in 2012 the Supreme Court prohibited Mr Chin from instituting any proceedings in any Western Australian court or tribunal without the leave of that court or tribunal.[1]
2. The proceeding that Mr Chin seeks to commence is annexed to an affidavit which he swore on 26 January 2026 (Proposed Action). The first defendant to the Proposed Action is the Registrar of Titles. The second defendant is the State of Western Australia. Mr Chin describes the proposed action as one in which he 'seeks compensation for loss of commercial utility and rental income formerly attached to Unit 1/383 Victoria Road, Malaga, arising from acts or omissions of the Registrar of Titles in connection with development approval DQ‑154/2015/A and the subsequent operation of Unit 10/383 as a lunch bar'.
