- The plaintiffs Daniel and Eliza Ng are the owners of land and a residential building situate at 4 Burley Griffin Place, Eaglemont. The plaintiffs engaged the first-named defendant, Kim Rockman, who is an architect, and the second-named defendant, Joswill Nominees Pty Ltd, which is a building contractor, to carry out domestic building works on their property.
- In due course a dispute arose between the plaintiff and the defendants in relation to the work. Apparently the parties were unable to resolve that dispute and the first defendant issued a proceeding against the plaintiffs in the Domestic Building List of the Victorian Civil and Administrative Tribunal (VCAT). The plaintiffs filed a counterclaim in the same proceeding.
