Body Corporate and Community Management Act 1997 (Qld) (), and (3)(a)
Body Corporate and Community Management (Accommodation Module) Regulation 2020 (Accommodation Module)
EXCLUSIVE USE BY-LAW - whether a resolution to grant exclusive use of most car spaces at the scheme to one owner was within the power of the body corporate to pass - whether the resolution was reasonable - TIME LIMIT - whether there is good reason to waive the time limit applying to the application.
(a) a declaration that resolution 9 passed at the annual general meeting held on 28 June 2004 which caused the grant of exclusive use of the car parks in the scheme to lot 8 as depicted by the hatched areas marked "B" on Plan C of the Community Management Statement dated 7 July 2004 as recorded in the Land Titles Registry under dealing number 707887528 ("the New CMS") was at all times invalid;
(b) that the body corporate shall within six weeks of the date of this order record a new community management statement deleting the exclusive use areas referred to at Schedule E and depicted by the hatched areas marked "B" on Plan C of the New CMS.
In the context of waiver or extension of time limits, the incurring of prejudice by a party which cannot be adequately compensated for is usually fatal to the grant of an extension.
