[2010] VCAT 1258
Victorian Civil and Administrative Tribunal
2010-07-23
Original judgment source is linked above.
The Tribunal has jurisdiction to determine a proceeding under a planning enactment despite any failure to comply with the planning enactment or any other enactment and, in doing so, may determine to disregard that failure if the Tribunal considers it in the interests of justice to do so.
Would it be in the interests of justice to disregard the failure to apply for an extension of time within three months of the expiry of the permit?
Should the permit be extended having regard to the planning merits?
[2] This was listed as a question of law, to be determined at a later date. The parties agreed to the adjournment of that hearing pending this determination.
[3] Reasons for making an order for joinder were given orally at the hearing and will not be repeated here.
[5] Mr Mutsaers gave sworn evidence that he assumed this had been attended to. His representative had originally submitted amended plans for endorsement and was told that minor matters needed attending to before they would be endorsed.
[6] The contested condition that requires the removal of the front (original weatherboard) dwelling.
[7] Including people seeking refuge and accommodation after the bushfires.
[8] Within a week of being advised by the responsible authority.
[9] (Red Dot) [2008] VCAT 1608, a decision of Deputy President Gibson.
[10] Including myself, for example in Waraglen Developments Pty Ltd v Maroondah CC [2008] VCAT 2582
[11] Deputy President Gibson in Burleigh v Frankston CC [2007] VCAT 1414 held that a responsible authority has power to make a decision on a request made out of time, but that it does not have the power to extend the time of the permit.
[12] Relative to section 69(1) of the Planning and Environment Act 1987.
[16] An additional piece of evidence that supports this finding is that Mr Mutsaers advised that he was sent accounts from this town planner following his instruction to submit the final plans for endorsement.
[17] He was only informed of this possibility immediately prior to the hearing of the related proceedings
[19] In addition to other relevant but less pertinent matters.
