Judgment (revised from ex tempore)
- These proceedings are a representative action arising out of the interruption occasioned to European river cruises in May and June 2013 due to extensive flooding. The hearing of the lead plaintiff's case, and certain common questions of law and fact which are yet to be determined, is due to commence on 26 April 2016.
- At a directions hearing before me on 5 November 2015, the plaintiff was granted leave to file in court a notice of motion seeking leave to amend his statement of claim. At that time it became clear that the defendant not only opposed leave to amend being granted, it also wished to agitate a number of matters that potentially affected the progress of the proceedings, including the topic of whether subgroup representation should be ordered and whether there should be an order for class closure (see Lam v Rolls Royce PLC (No 3) [2015] NSWSC 83 ("Lam No 3")). Accordingly, the hearing of the notice of motion was adjourned to today.
