Moorabool Wind Farm Pty Ltd v Moorabool SC [2012] VCAT 1393
For Raymond Michael Sullivan & Lynette Ann Sullivan
(3) The Tribunal may make an order under subsection (2) only if satisfied that it is fair to do so, having regard to -
(a) whether a party has conducted the proceeding in a way that unnecessarily disadvantaged another party to the proceeding by conduct such as -
(i) failing to comply with an order or direction of the Tribunal without reasonable excuse;
(ii) failing to comply with this Act, the regulations, the rules or an enabling enactment;
(iii) asking for an adjournment as a result of (i) or (ii);
(v) attempting to deceive another party or the Tribunal;
(b) whether a party has been responsible for prolonging unreasonably the time taken to complete the proceeding;
(c) the relative strengths of the claims made by each of the parties, including whether a party has made a claim that has no tenable basis in fact or law;
(e) any other matter the Tribunal considers relevant
Section 109(3)(b) - unreasonable delay
Section 109(3)(c) - relative strengths of the claims made
(i) to ensure that those affected by proposals for the use, development or protection of land or changes in planning policy or requirements receive appropriate notice;
(j) to provide an accessible process for just and timely review of decisions without unnecessary formality;
Section 109(3)(e) - any other relevant matter
Adjacent on the southern side of Ballan-Egerton Road is a Planning Permit (No. 2009012877) for Use and Development of a 107 Wind Turbine facility and associated buildings and works as approved by the Minister for Planning in October 2010. Whilst the current policy places an onus on the wind farm applicant to avoid turbines within 2 kilometres of a dwelling, the practical effect of allowing dwellings to establish within 2 kms of a wind turbine undermines the intent of the policy to keep these conflicting uses separated.
