(a) the reviewable decision is set aside;
(b) there is insufficient information upon which to determine PAWE, and
(c) in the event the claimant provides further information and documents to the insurer the insurer is to redetermine PAWE under Sch 1, cl 4(1).
[1] The claimant details his alleged earning history from arrival in Australia in December 2021 to the date of the accident in his submissions.
[2] Uber statements for the period 3 February 2024 to 2 February 2025 have since been provided by the claimant in response to interim directions which required the claimant to provide the documents requested by the insurer.
[4] Given the accident occurred only two days after commencement of this statement period it is unlikely any of the earnings were received by the claimant before the accident that is, on or before 2 February 2025. It is more likely they were received post-accident. The gross earnings amount is also indicative of most, if not all of the stated earnings being received after the accident as it is unlikely the claimant could have generated all of this income in just 2 days, on 1 and 2 February 2025.
[5] In February 2024 the claimant's total income was only $616.08 versus $4,337.28 post-accident in February 2025; in March 2024 the claimant's income was nil versus $6,814.73 in March 2025 and in April 2024 the claimant's total income was $2,023.99 versus $4,664.22 in April 2025.
[7] As there is insufficient information as to the amounts received by the claimant into his bank account and other expenses it is not necessary for me to address the claimant's submissions that certain business expenses should not be deducted from gross profit for the purpose of PAWE.
[8] That is, the original version prepared by the claimant's accountant and lodged with the ATO and not the version the claimant admits was amended by him for the purpose of his claim.
